Dear Friends,
I am going through a very very abusive marriage and want to end it as soon as possible. So I have applied for a divorce. In my country this takes some time to materialize. Meanwhile, i am thinking of appying under the FSW scheme. I qualify with 67 points . My husband is not aware of this as i am sure he will try to come along with me which i want to totally avoid.
I also hold a B1 visa to US. I am planning to go to the US next month as i cant stay in this country another minute as my husband is creating a lot of problems for me .
My question is which is more practical. Going to US on a B1 visa and then converting it to some other Visa and staying there. Or applying for PR to Canada. As PR to canada will take some time . Is it advisable to to travel to US. Pls help with suggestions. I have a small kid and want to raise my kid away from this abusive environment.

I am sorry for the situation you find yourself in. I don't know much about this issue, but wouldn't your husband have to give his permission for you to take your son out of the country otherwise could you face legal problems? I hope others will come up with the answers you require. Good luck.

As pippin pointed, you have to clear legally the kid custody first as you will be required such legal paper for Canada Immigration.

Secondly, you need to see if your experience fits any of the NOC, and for which Cap is not reached. You can submit by yourself, your husband can't stop it.

I feel your US is more guaranteed and more affordable. Your Canadian visa will take something between 16-24 months depending on many factors like your visa office!

You better go to US and fight for the legal authority of your child. This is the most important thing for you right now.

hi,

sooo sad to hear that. By reading your post what i can say is first you can go to US and from there you can apply for PR to Canada, if you don't get a good job or you if you are thinking for a permanent settlement.

this my suggestion ....you can wait for other senior members advice as well and take a gud decision which ever you think it is good.

Thanks for the help. Is it possible to get a job when one goes on a B1 Visa. I was thinking of starting the PR process and then proceed to US. But is it ok if i go to US after i submit my application for PR. Will there b any complications??

B1 is a Visitor Visa. You are taking a major risk by doing this. If caught, it will lead to deportation & also effect your Canada FSW application.

Apply from your home country for jobs in USA, travel on the right Visa.

Hi Yukon,
Thanks. Is it illegal to travel to another country while PR is getting processed? Y would i get deported if i travel on a B1 visa.

You misunderstood.
You can travel to USA anytime you wish but cannot work on a B1 Visa.

Yes, I second yukon.

Since you are applying for Canada PR, you should be very careful. Your R B1/B2 visa is for visiting US only and not for the work. If you stay illegally in US or started working without valid WP and get caught, it will be big problem for your canada PR. In future you requird to submit police clerance certificates from the countries you visited and lived for more than six months.When you apply for FBI clearance for Canada PR application, it will show everything. So my advice is, whatever you do, do it legally.

The next problem is when you travel to US(or somewhere) with your kid without the consent of ur husband, and your husband lodges a legal appeal against you for such act -then again problem for your Canada PR.

I don't know which country you belongs to, but when you have to apply for your kid's passport your husband's permission is required.

So plan your move accordingly.
