Problem with Spousal Sponsorship inland

Hi, I am in a stressful situation at the moment and would appreciate any help. I, a Canadian citizen sponsored my common law partner who lives with me in Canada last February. Along with her application we also applied for her open work permit, which we got already. Her visa is currently ay 85 % processing and we just sent the request to get her background check processed from her home country. From what I understand, this is the last step and after this all that would be needed to be done is send the passport. Unfortunately, her mother passed away last night and she left Canada to attend her funeral. I spoke to immigration and they said that they do not recommend leaving the country during the entire process and moreover she also does not have a visitor visa to enter the country. So, I am not what to do now. Just tell immigration the truth, apply for a new visitor visa to enter Canada from her home country or just wait for immigration to send request for passport and have her somehow send the passport from her come country instead of sending it from Canada. We don't want to start the process all over again. The processing time to process visitor visa from her own country is 120 days and ideally the PR should come sooner.

Your help in this situation would be appreciated!

I am so sorry to hear that you and your spouse are in this difficult situation.

You can wait to see if there is anyone on this forum who has been in a similar situation and get their feedback.

But I would strongly advise that you ask the IRCC directly. Check to see if it is possible for her to send her passport from outside of Canada and have it returned to her at her address outside of Canada - if yes, she will probably have to include a return envelope from FedEx/DHL/UPS/other reliable international courier. If they ask why she left the country, tell them about her mother's passing.

Also, if you call on her behalf and you were not originally designated as a representative who can access her application on her behalf, you might not be able to receive details about her application. If that's the case, she will need to try to call IRCC in Canada from her home country. If she is unable to access that phone line, then she might need to talk to/contact her local Canadian visa office to evaluate her options.

Would warn you that the progress bar is just an estimate based on average processing times. Unfortunately this situation puts your partner in a tough situation. Your partner needs to be in Canada to qualify for inland sponsorship. Although short trips are usually overlooked you are talking about potentially many months Outside Canada or requiring passport stamping outside Canada. I would consider speaking with a lawyer to see if there is any way to ask for H&C consideration because of the death of her mother.
