Hi,

This is Bhavani Shankar, based out of India and I would like to apply for a canadian PR, but I have a peculiar situation as below and searching the internet yeilded no results of my case, Hence I am posting here for thoughts if someone has come up with a similar situation.

I have been working in the IT industry in India for the past 6+ years as a software developer drawing a salary of 10 Lakh INR per annum, also I have been contributing to the field of opensource as an Ubuntu and Debian Linux developer primarily. Profile below:

The main thing is I am afftected by Cerebral Palsy to the extent of 50% by birth and I am not under any medication or assistance through out my 30 years of life, and have recieved various International awards for my work in opensource and disability sector in India as below

A silver medal and an achievement award from UNESCAP, United Nations, Bangkok, in October 2013, for my outstanding performance in Global IT challenge for youth with disabilities event 2013.

Awarded Helen Keller Award as a role model for persons with disabilities for my work in IT and open source in December 2013.

Awarded Aryabhata International award 2013 in the state of karnataka for my contributions to IT field.

Nominated for National Award as a role model with disabilities, Govt of India 2013, 2014, 2016

I also hold a Bachelors of Engineering in electrical engineering from VTU and a dual MBA in Marketing and finance management from Symbiosis Pune and have also a band 7 IELTS (General training) score in all bands

The dilemma I am having is when I approached an immigration consultant, they advised me that I cannot apply for canadian PR due to my disability (even though I have a valid US and UK visa presently along with multiple Schengen stamps on my passport), stating that I might be medically inadmissible.

The other point is m planning to migrate with my family and my wife and daughter are completely normal without any disability.

Kindly suggest me if I can apply as a primary applicant for Canadian PR as searches on the internet yielded negative results primarily.

Thanks in advance and sorry for the lengthy post as I am in a real dilemma and looking forward at some feedback.

Impressive achievements.

Usually, they would assume that you are an excessive demand on health services or social services. But I do see an exception here since you state that you are not under any medication or assistance. And I believe there is more than enough proof by way of your work experience(s) etc to show that you do not require social assistance.

When it comes to the crunch, you can ask your Doctor to conduct and an assessment and include it in your application. Additionally, you can ask your manager and/or colleagues to also do a write up to support that fact that you do not require any assistance to carry out your duties.

And in order not to prolong the process, I suggest that you include all these(upfront) when you submit your application.

Once you are not taking any medication(s) and you also do not require the assistance of social services, then you cannot be classified an excessive demand.

You are good to go.

Please go ahead and keep us posted every step of the way.

Hello Bhavani,

Those were great achievements by you, not withstanding your condition. I think you are good to go, for the fact that you are not on any medication and do not need any assistance.

A family friend who landed in Canada in 2015, told me about a immigrant neighbor whose dependant has same condition as you and was issued Permanent Residency. Normally the medical condition that will make one inadmissible is same for the principal applicant or dependant.

Bottom line is you are good to go. Don't allow any fear to kill your dream. However, ensure you get your Doctor to do a comprehensive report on your condition attesting to what you have said and attach same to your application.
