Hi,
I have a question and I can't seem to find an answer to it. My bf is Canadian, we have only been together for over 7 month. We moved in together 3 months ago, right after that I got pregnant (yay!!!).
Because my current closed work permit expires in one year and I intend to stay here, I would like to apply for PR. My first attempt to apply as a skilled worker failed, as they have received already too many applications. Now my consultant suggests that my partner sponsors me but I read that we have to be living together for at least 12 months to qualify as common law partners. Does anyone know if the fact that I am carrying his child changes that?
What if we got married? Would we still have to have lived together for at least 12 months?

1, No, being pregnant doesn't change anything, so still need to co-habit for 12 months before you can apply as C/law.
2. No, if you marry, there is no 12 months living together requirement.

the only way you would qualify is if you got married. The fact that you are pregnant will help you only when it comes to actual residency issuance. As a married couple with a common child you would be exempt from conditional residency thats imposed on couples that have been married for under 2 years.

That will only apply if the child is born before the application is submitted. The child exemption from Condition 51 is not retrospective.

On a side note, the CRA has slightly different rules around common-law. So you and your partner should keep in mind that you will become common-law for CRA tax purposes effective the day your baby is born and you are living together. In this case there is no 12 month requirement. Of course this doesn't matter at all if you get married before then.

Have you given any thought to the cost of giving birth in Canada? Does your work permit entitle you to provincial health care coverage?

I am covered by MSP as I do have a valid work permit until March 2016. I have just found out that I can also extend my WP. I thought there was a 4 year limit on that (and I will have been here 4 years next year) but I am NOC level 0 and eligible to apply for another extension.
