I'm 7 months pregnant and my visa is going to expire nov. 28 2011. i was thinking about getting a new WP but then i would only be working for 3 weeks on it, with no gaurantee that i will be going back to work with my current employer. would it be wiser to switch to visitor status 3 weeks before my due date? would i still get my paid maternity leave?

To be able to get EI (maternity leave benefits) you must have a valid SIN. Better check with your local Service Canada or give them a call to clarify everything. Since technically you can apply for mat leave 12 weeks before your due date, just don't know if they will cut your benefits once your work permit expires in Nov. Even if you switch to visitor status, your SIN will still expire when your work permit expires so that will also mean you can't collect mat leave benefits.

what i may suggest to you, if you're not done yet the four years and 3 mos with in our maximum stay here in canada then, you might talk to your employer about your situation.

type this-----labour.gov.on.ca/english/es/pubs/guide/pregnancy.php

Am also in the same situation. I'm 4 months pregnant now and already have my extension of WP in progress. I dont think my WP would get approved and I'll be applying for visitor for worst case.

I called the service canada team to check if am eligible for mat benefits. They strictly told that they need a valid SIN card to be eligible for mat benefits.

But my doubt is , would i be eligible for pregnancy benefits either ? Assuming that I might have a valid work permit after delivery ?

I also applied my PR , got my AOR and medicals request too !!

When you do get your WP and renewed your SIN you will then be eligible for the maternity benefits as long as you have accumulated 600 hours in the last 52 weeks. Service Canada is very strict about this. Another thing to worry about is health care, if you will be covered when you change your status. In Alberta, as soon as your WP expires your health care also expires and they can only give you a one-time 90 day extension. After the 90 days health care coverage extension, they won't renew it until you show them your new WP.
