Pre-approved PR application after 14 months - but I can't leave yet....

Hello Everyone,

I've spent days reading up on this forum and I learned a lot, trying to find answers to my question.

My husband recently got pre-approved for CAN PR, and is at the point of submitting passports and photos. However, due to COVID, some of his family members got really sick, therefore its best that we stay for a little while until his family gets back on their feet.

My question pertains to the pre-approval email, it states "to meet travel exemptions - you need to come to Canada to settle permanently (you cannot come and leave to go live in another country, even if its temporary)"

is this enforced? can we go to Canada pick up the PR, and come back to Singapore to take care of his family for 1 yr and then go back to Canada? I think under normal circumstances its ok, but bc of COVID and border controls (with stricter controls in place)?

I am freaking out because its so difficult to get the Canada PR, and I don't want to look like an ungrateful daughter n law just leaving with their son (it was already hard enough as it is)

anyone can help me that would be great, so great!

Are you a Canadian? Did you have to show proof that you are relocating to Canada when your spouse gets PR to get approved for PR?

I am a Canadian yes, but my husband is not. We were never asked to show proof of relocation or anything.

We submitted the application and accompanying documentation. Then we were requested to provide updated police reports, medical report and fingerprint. and most recently request for passports and photos.

Were you living in Canada during the sponsorship application? If not you would have been asked for quite a lot of proof that you would be returning to Canada after your spouse gets PR. Too many couples were not relocating to Canada after PR approval so now IRCC requires an excessive amount of proof like, for example, proof that you have given notice at your job, proof that you have sold or given notice at your home abroad, proof of a new job in Canada, proof of a job in Canada, etc. There are many posts about couples getting PFLs because they have not provided adequate proof that they will be relocating to Canada soon after the spouse gets PR. Yes you will likely be able to get away with landing and returning back to Singapore. If you stay away for so long if not longer there will be likely be more proof required for any future applications because you did not relocate to Canada after PR approval. Your spouse will also not be able to count the time abroad towards his RO even if he is with you in Singapore because he didn’t establish himself in Canada before leaving.

actually, I am not in Canada. We've been in Singapore this entire time. Which also leads me to be quite surprised as we were not asked for any proof.

Very strange. Did you apply from Singapore or from Canada? Did you update your address? Proof of intent to return is a required part of the process.

I applied from Singapore. We were in Singapore the whole time.

we were only thinking of staying for 1.5 yrs, which leaves 3.5 yrs for RO. Its just to make sure we nurse his parents back to health first before we leave.

so what i've gathered is that process wise, even with travel restrictions, we can leave canada within a few weeks of getting the PR. come back in a year, or 1.5 yrs, and still have 3.5 years of RO living in canada.

is that correct based on your message?
