Hello everyone,

I have a few questions on how my wife will be able to land in Canada. She currently has a 7 year Visitor Visa, and came to Canada in October of 2015. She is leaving in March 2016 to go back home (6 months expired) until our application has been finalized. I applied as an (Outside of Canada) application for Spousal Sponsorship. The issue with Kazakhstan is an EXIT VISA will take 60 days to complete, but if my Wife gets her PR Visa and it expires before this time there is no way she can quicken the Exit Visa process in Kazakhstan. She cannot get an Exit Visa early as it will only be valid a certain amount of days.

At this point I'm not sure about our options. She could come back in right when I'm notified that she needs to send her passport that week on her Visitor Visa, and if possible we could issue the passport within Canada for her PR Visa, then she can apply for permission from Kazakhstan to live abroad while 'in Canada'. Then we would need to drive down to the US Border to re-enter Canada to validate her PR? (Would she need a VISA for US?) We live in Western Canada, so I don't know if there is an office her, and they require 2 months to set an appointment.

What are our options due to this Exit Visa issue?

Thank you.

Hi

Unless there is a particular reason that she is returning to her country, it would probably just be easiest to extend her stay and remain in Canada until she becomes a PR.

If she lands at the Canada-US border, she doesn't need a US visa. She would just tell the US officer that she is flagpoling and they will give her an administrative refusal.

Hello everyone,

I had another quick question. My wife is back home now for a few months (will return June depending on the application), but was asking if she does apply for an Exit Visa in Kazakhstan instead of coming back here and us driving to the Canadian - USA border, and her exit visa isn't approved and her temporary PR VISA expires, can she extend it? Or do we have to re-apply for sponsorship? Her medical is due September 2016, and our application should hopefully be approved by July, however it's too close and risky to try a 60 Day Exit visa process...

We will most likely just apply at Canadian - US border to flag pole it back, but just encase she does the Exit Visa, I'm worried the PR Visa will expire before she is approved to leave the country. This will also void her 7 Year Travel Visa to Canada. I couldn't find anything on extending PR Visas.

You couldn't find anything on extending the validity of a COPR because it doesn't happen. Use it or lose it. If she doesn't land prior to the expiry, you will have to start the sponsorship process from the very beginning.

Thank you for your response. I guess the most logical approach is to not apply for the exit visa, but come back to Canada, and drive down to the US border to flag pole back.

Have people done this flag polling thing successfully without issue? I haven't heard of this before until coming here.

Yes, it's very routine. Most people who are in Canada with an outland application do it this way.

Thank you. I will let my wife know once she lands back home.

Thanks again for all the help! Very new to this, and I don't want to risk running out of time due to the issues in her country for processing times on Exit Visas. She can apply in Canada once she has a PR anyhow.

EDIT:

I just took a look online, looks like Coutts only offers immigration services now in Alberta.

Is it possible to book an appointment instead of driving down?

I'm going to see if my wife can get a US VISA, and I will plan a 1-2 day trip for us to see a friend in LA if possible. Get 2 birds with 1 stone!
