Hi,

On the CIC website it says to maintain PR:

If you have been a permanent resident for less than five (5) years

you must show that you will be able to meet the minimum of 730 days of physical presence in Canada within five (5) years of the date you became a permanent resident.


OPTION 1. Accompanying a Canadian citizen outside Canada

You may count each day that you accompanied a Canadian citizen outside Canada provided that the person you accompanied is your spouse, common-law partner or parent (if you are a child under 19 years of age).

Evidence required

You must provide supporting documents to prove that:

The person you are accompanying is a Canadian citizen; and
You are the spouse, common-law partner or child of that person.

It is option 1 I had a question about. If my wife and I move overseas together on a 5 year work contract, this CIC statement makes it look like as long as we show our joint travel and rental agreements overseas etc. I should maintain my PR.

The second question was with regards to changing from PR to Citizenship if we both lived outside Canada. CIC website says:

Time you have lived in Canada to gain Citizenship

You must have resided in Canada for at least three years (1,095 days) in the past four years before you apply. This does not apply to children under 18.

This statement says 'resided in Canada' which I would not have as we would be overseas, however the previous statement says for PR:

You may count each day that you accompanied a Canadian citizen outside Canada provided that the person you accompanied is your spouse, common-law partner or parent (if you are a child under 19 years of age).

So they are willing to accept my presence outside Canada as if I had physical presence for PR. So does this technically mean that they would accept this PR status when it comes to requesting Citizenship or do we have to move back to Canada after 5 year contract. Wait 3 years and then apply? We would have joint RSP's and possibly property in Canada to show our 'ties to Canada'.

Can anyone shed any light, the wording makes it unclear.

You can retain your PR if you are accompanying your Canadian spouse outside of Canada. However, to qualify for citizenship, you must be physically present in Canada for 4 out of the last 6 years (under the new rules).
