How is she eligible for PR? And if so why has she not done so? Does she have Master/PhD, fluent in French and English, skilled work experience. She can stay up to 6 months or less if CBSA determine she is trying to live in Canada. Canada is not a long term solution.
I believe her mom does not qualify for direct permanent residency. Perhaps my cousin would need to explore sponsorship options under a parental scheme if any, which i understand from the above comments that is not easy and take many years

Parent sponsorship is lottery based and right now closed. Cousin would have to meet LICO for the number of people in her family for a minimum of 3 years, and then enter the lottery. So PR is many years away or not even going to be picked. She will want to start working ASAP and meet LICO and not go below LICO.

It could take over a decade and may never be possible. Your cousin has to prove she makes a certain income for 3 years to even qualify to potentially apply. Parent sponsorship is far from guaranteed. The mother needs to be prepared to return home after their visit.

How is this an H&C situation? Wanting your mother to move to Canada with your Is not an H&C situation. If she is denied H&C, which is very probable, the mother may have difficulty ever visiting Canada again. There is significant consequence. An H&C application would also not give her status so if she can’t extend her visitor status she would be staying in Canada illegally which would have significant consequences. Your cousin’s mother needs to be prepared that this is a visit and will have to return home. Your cousin needs to prepare and evaluate whether she can live as a single mom in Canada.

The challenges of single motherhood, coupled with the complexities of obtaining custody of her child who was born without Canadian citizenship, have significantly impacted her ability to meet the residency requirements. Would that be considered under H&C criteria?

She can certainly try but it would be risky if she managed to enter Canada without being reported. Not settling in Canada and then getting pregnant the next year are personal choices. If denied PR card renewal based on H&C with minimal time in Canada typically has a long processing time and could result in her losing PR status. If you enter Canada and don’t get reported for not meeting RO the best option is to not interact with IRCC and wait out the 2 years. The challenges of single motherhood are likely to get much more difficult in Canada. Unless your cousin has a job lined up that can cover cost of living and childcare she should also be assessing whether Canada is an option.
