Hi

I came to Canada on 18th OCT 2011 as permanent resident .Then went back to India from 12th Feb to 20th March 2012 apprx. 40 days then stayed here for 20 days again went to India from 9TH April to 10th June 2012 apprx. 61 days.So total 101 days I want to clarify whether this time period for my stay away from Canada will be deducted or will counted to complete PR status on 18th OCT 2014 when apprx. 2 years will be completed .My wife and two kids remained here since 18th October 2011.My wife was primary applicant and we came under fast track under FSW (federal skilled program)

Secondly for citizenship I have to stay one more year after completing PR status without break or I can Visit India in that period and if i visit for how long I can visit so that my process is not effected.

Thanks and Regards

The days you stayed outside Canada will not be counted towards the PR residency requirements nor to the citizenship requirements. You will have 730 days in Canada in late January 2014 if you make no more trips. However, the PR residency obligation is a rolling requirement so once you have been a PR for more than 5 years, the days you stayed right after your landing will move outside the 5 year window and need to be replaced with new days in Canada.

If you do not leave for any more trips, you might be eligible to apply for citizenship at the end of January 2015. If you go to visit India for a month, you will delay your citizenship application by a month.

You can stay outside for up to 1095 days (3 years) in your first 5 years as a PR and in any rolling 5 year period after that.

2.Do I have to be 2 years continuously in Canada for 5 years period or can I be for example 6 months outside canda 6 months in canada for 5 years???

Your days in Canada can be accumulated from many visits. It is enough to spend 5 months a year. After 5 years, you will have 5x5=25 months in Canada when the required amount of time is 24 months (=2 years). However, keep in mind that with many short visits, it will be harder for you to prove your time in Canada in case immigration doesn't believe you than it would be if you had a solid 2 year stay in Canada during which you were working or studying and would be able to prove that.

3.How many times can I renew my permanent resident card???

There is no limit how often you can renew it as long as you always meet the residency requirements.

I have been in and out of Canada for about 4 1/2 years since my landing in 2008. Currently, i am staying permanently since two months. I still need about 17 months to fulfill the required 730 days to renew my PR. Can I stay with my expired PR until I fulfill the 730 days ? I have a valid passport and a valid Canadian driver license. In case that the best for me is to wait till I complete the 730 days, Will I be subject to question about my absence by the officials, on applying for renewal? And what should I prepare if this will be the situation ?. I really appreciate the help and advice you and the others are offering to the new immigrants
one more question can i apply for renewal of pr card before the completion of 730 days.

thank you and have a good day.

Yes, it is perfectly legal for you to stay in Canada with an expired PR card.

I have a valid passport and a valid Canadian driver license. No, you will not be asked any questions about your absence as long as you do not apply until you have 730 days in the past 5 years before applying. Immigration actually has rules that forbid them from going further into your past than the past 5 years before you applied to renew.

one more question can i apply for renewal of pr card before the completion of 730 days.

You could but it would be a very bad idea. You would open yourself up to examination by immigration and attract attention to the fact that you did not meet the residency requirements. Worst case, immigration could revoke your PR and send you home.

thank you and have a good day.
