PR Status after 730 days obligation is over

Hi All,

I had asked earlier but wish to know from all, once again that if someone goes after the 730 days obligation, back to Canada, like in my case. I had landed in Canada back in Sep-25, 2008 and only stayed there for 22 days and came back to my base country. Now when the time has come, this September 2011, I have to finally pack my baggage, I have problems leaving my present job until next year July 2012.

My Q is to all, if I take this step going in July 2012, would it make problems, pls. advise.

If immigration realizes that you don't meet the residency requirements, they can start proceedings to revoke your PR. You would be able to appeal but having stayed outside Canada because you have a good job is not considered a very good reason.

If immigration doesn't realize it, you can enter Canada, stay without leaving, let your PR card expire and not apply to renew until you have 730 days and then you should be ok.

Hello leon,

What you mean by 'immigration realizes'. how do they know who has been living outside canada, are they gonna stop me at the airport or will come to know when I go for RP renewal after staying 730 days from my date of entry, later than Sep 25, 2011. Do they calculate from the date of landing or from the day I left canada on Oct 21, 2008, after staying for 3 weeks from 25-Sep 2008.

They don't know everything, enough people get through to see that but they do know some things. They can ask you how long you were outside Canada, look at other stamps in your passport and I know they work with the US border so they may see information like if you have entered the US. They may just pick up on that you are nervous and hiding something.
