I got my PR in 2010 and we shifted to Canada in 06/2013, my wife and children are staying her since Jun 2013. I have to travel for work and because of that I am not able to complete my RO. I have only 500 days and my PR is turn down and I have appealed on the humanitarian basis. Please guide me what should I do.

Working outside of Canada unfortunately isn't accepted as an H&C reason for failing to meet the residency requirement. Do you have any other reasons that forced you to remain outside of Canada and not meet RO? If not, then you should expect your appeal to be refused. Once you are ready to return to Canada, your wife will have to sponsor you for PR through family class.

I was working for the company which I have started after moving to Canada. For developing the product I have to travel. I paid my income taxes for the last three years.

Based on the information you've provided, you should expect your appeal to be refused.

Again, once you are ready to move to Canada for good, your wife will have to sponsor you for PR.

Hi scylla ,
Based on your experience in my case the appeal on Humanitarian basis for my PR will be turn down. This will not impact my wife and children PR in Canada ? I currently in Canada and is it possible for my wife to start the process of sponsorship now itself ? Please guide on this issue.

From 2013 I am working in Canadian Firm which I own and because of the product development I have to travel and company got revenue for the job performed in USA.

Your refusal will not impact the status of your wife and child.

Your wife can sponsor you for PR as soon as you officially lose your PR status. If you have submitted an appeal, then your wife cannot sponsor you at this time. You have to wait for the outcome of the appeal.

Can anyone tell me if I even have a chance at getting my PR card renewed in time...

I am traveling on Nov. 11th to Australia for business. I have all of the URGENT documents ready to overnight to Nova Scotia today. I have followed all of the instructions...but I am traveling in less than 3 weeks.

Getting a travel document once in Australia is not an option because I will only be there for 5 working days, and I was told it takes 10-12 working days to process.

Do I have a chance at getting a new PR card in time? Is there any other options I have missed? Has anyone ever been admitted back into Canada with an expired PR card?

CBSA doesn't care, they can determine your PR status with a valid PR card, expired card, or no card at all.

The only problem is boarding an airplane. Airline will demand a valid PR card or PR Travel Document to let you board a plane to Canada. Only exception is if you're a US citizen so exempt from eTA, then you should be able to fly on passport alone.

So if you don't have your PR card back in time, can't apply for PR TD and aren't a US citizen, the only other option is to fly to a US city close to border and drive into Canada.

Oh thanks so much! I am an American citizen with a valid US passport, so I should have no problem entering Canada then?

Again, entering Canada is no issue. It's boarding the airplane that is your only concern.

If you hide the fact you're a PR from the airline, pretend you're a foreign national/visitor to Canada only, then you should be able to board plane with US passport alone.

Thanks for the clarification.. so by "hiding" it you would also mean not stating I am a Canadian PR once arriving in Australia? I do have an address in the US that I can use...but this sounds risky?

So if the airlines know I have a expired PR card, they will not let me on the plain...even if I am a US citizen?
Thanks again..

What you tell Australia immigration when entering their country is irrelevant with anything to do with returning to Canada.

Yes if the airlines know you're a PR but you don't have a valid PR card or PR Travel Doc, they could technically refuse to issue you a ticket and deny boarding. Perhaps they would still let you on as a US citizen, or perhaps not, it's really up to them.

Also there is no guarantee that you will be able to "hide" from the airline. After eTA program becomes 100% mandatory in November, even if it doesn't affect US citizens directly the information sharing between Canada and airline may become more open and you may be identified as a PR upon check-in. There is really no firm answer to what will happen here, you would just need to try and see what happens. Either way though I certainly wouldn't volunteer your PR status to the airline.

Perfect thanks. I don't remember ever telling an airline that I was a PR before.. I have traveled form Cambodia, Australia and Fiji since becoming a PR and I only remember using it at customs in Canada.

I am not familiar with the Eta, I will have to look that up.

Am I correct in thinking though that Canadian immigration can deny my entry in Canada since my card is expired?
