Just to get things straight...

At this point you have been only 743 days in Canada within the past 5 years and you want to leave in November for another 3 years?

Yes 743 Days in the period 18 Sept 2011 to 18 Sept 2016, just fulfilling the RR.
It is a border line situation. All the same I have to leave in Nov 16.

WHAT IS THE BEST OPTION .?

What I know... But I think, if you can, you should stay until you can apply for canadian citizenship. So if you realy have to leave the country for some reason, you don't need to be worried about losing the status.

Just a opinion.

Good luck.

I wouldn't bother applying because if you apply (urgent process) you have to send in a copy of the booked flights. Sometimes IRCC decides that one has to pick up the new card at the nearest office and you're not even in Canada. I don't think they're going to keep them for three years.

My friend who spent way more days in Canada applied a few month ago and left right after sending in the application. When she came back she notified IRCC that she's back home (meaning Canada) and she said she got an email from IRCC stating that IRCC verified her information. She's pretty sure that IRCC didn't work on her application as long as she had been out of country but there is no proof of that.

You won't just lose your status. You'll be able to apply for a PR TD, just don't push it. Thing is you shouldn't stay out of country for too long. I wouldn't take a chance. A secondary review might also be the result of being out of coutry for too long.

This is just my opinion!

Thank you for your reply.
I thought that urgent processing time , when evidence is ( ticket) is provided is about six weeks. I am fulfilling my RO as on 18th September 16, as required by law. As such I should be getting my new card by mid November before leaving Canada.
I have absented for 1082 Days and have been present for 743 Days. I also have relevant stampings on my pass port for All major travel and Exit entry through Air Ports.

I feel the spirit of law is to allow a PR , sufficient Liberty to travel as per his/ her will and not not to creat unnecessary obstructions by raising doubts. Besides this is my second renewal which supports my bonafieds to have ties with this country.

I do not want to renounce my original citizenship and apply for Canadian citizenship, but travel regularly to be with my children.

Pl inform me if I can get travel permit on my Expired PR card and what are the conditions.

Thanks for your interest in my case.

Sure you can apply, I didn't say you can't! I posted my opinion as clearly stated!

In case that it takes longer than 6 weeks (there is no guarantee for processing time!!) you'll be able to apply for PR TD in your home country. Or someone could send the new card to you.

You're right about the days you're supposed to spend in Canada by law. What I meant is I wouldn't take a chance and stay out of country for too long. As I said it is just my opinion.

Be aware that rules are subject to change and no one knows when those changes will happen and if they happen at all. Best example is the (kind of) sudden change of the rules for foreign buyer. Some people are not in the best position because of that change...

So yes (for now) you can stretch your visit back home to the limit.

Good luck.

Don't forget that it's a ROLLING day count, not just in 5 year chunks. So, if you have countable days almost 5 years ago, they will start to drop off the back end. You will need to be replacing them with new countable days of physical presence in Canada in order to maintain the residency obligation requirements. Do the maths and check that on ANY day, you can look back over the preceding 1825 days and have 730 of them physically present in Canada.

Fully appreciated your opinion and advice Tricities Just one question. Can I apply for a travel permit on my expired PR card ? I will have about 600 Days to my credit if I leave in November and return back in early 2018.and should be able to complete my PR obligation In about 3-4 months..

If you attempt to apply for a Travel Document or to renew your PR card with less than the required 730 days, you risk having your PR status revoked. IRCC and CBSA don't believe in the "spirit of the law". They go by what the IRPA and IRPR say.
