PR renewal without meeting obligation

My PR card expried on 15th August, 2012 and applied for renewal. Recently I checked online status indicated - "We transferred your application to the local CIC office on August 20, 2012. The local CIC office may contact you."
I want to know, what is the meaning of it? Which level my application reach?

Why did you apply for a renewal when you don't meet the residency requirements? My advice is that you withdraw your application and hope that they will accept your withdrawal. You can apply again when you meet the requirements again.

What is happening now is that they have realized that you do not meet the requirements. The application process will take forever, you will probably be called for an interview eventually and told that you do not meet the requirements and therefore can not renew your PR card. Worst case, they can revoke your PR and send you home.

Now I want to know what si the power of Local office? Can they take decision or Sudbury office will take decision?

Or they alreay take decision.

Have you been out of the country for more than 3 years in the past 5 years? How long have you been in Canada?

Now that your file has been transferred to the local office, they will look into your application in detail and I believe they will make the final decision. I do not believe your file will go back to Sydney.

indeed applying for a new PR card when residency obligations are not being met is quite stupid...

You have 2 options.

1. Wait for the local office to make a decision on if you get to keep your PR.

2. Withdraw your application now and hope that they accept your withdrawal before they decide if you get to keep your PR.

By the way, I have heard of people withdrawing their application even at a time it was already by local office and it was accepted.

Dear Karenp,

I am my family (spouse and son) lived in Canada for one full year and 3 months only. I know that tha chances are very null.

I want to know How much time local office will take. Sydney office has sent the file on 20th August, 2012. If they say no so I will go back to India.

You need to have stayed in Canada for at least 2 years (730 days) out of the past 5 years in order to maintain your PR status. My parents have been here for 2 years and 3 days (733) in the past 5 years and they meet the residency requirement, even though it's only by a few days. They have had many issues with family members back home that they needed to attend to. In addition, my mother had retinal bleeding and dislocated her shoulder, so they were advised not to travel until she recovered. As a result, they weren't able to travel for an entire year. However, we ensured that they met the minimum requirement and thought that by meeting this requirement, their case would quickly be processed and there would be no issues.

However, their file has also been sent to the local CIC office. Their file was sent on July 25, 2012, and we haven't heard anything from them until now. From the messages I have received, it takes a very long time.

I am not sure I can advise you about what you should do. The experts on the forum are better equipped to help you. Leon suggested some options for you. Good luck with everything.

i have recently been through all this Leon is right if it's possible withdraw your application as soon as possible. because else local office might send you residency questionnaire and after that interview to decide to let you maintain pr status on humanitarian basis or not?
and trust me interview questions are not that easy i am not trying to scare you. but it's serious as immigration officer have to decide on basis of that interview and you need to satisfy him or her.
and by the way i was only short 2-3 months towards 730 days.

so withdraw it. complete 730 days rather even apply 2-3 weeks after completion of 730 days.

I understand you concern and suggestions. Now I have to leave country with expire PR. I have to have join my ongoing job in back home. I am on leave since 15th May, 2012.

Dear Leon, We are decided as per your advice on this forum and I sent my spouse in March but due to my parents medical condition she has to go back in June with my kid.

I have USA visitor visa upto 2018, I want to go to India through USA because cheapest Air fare and meet my relatives.

Can they allow me with expire PR in USA or they do not ask about PR?

The US won't care about your expired Canadian PR status. They will only care that you have the right visa to enter the US.

Thanks for adavise ! I am safely entered in the USA. If I want to come back in Canada through USA. Can they allow me to enter or ask any question? I heard that if I will take some Canada passing Car then its easy to enter? am I right? My case is with local office since 20th August, 2012.

We both (my self and my daughter) are eligible for PR renewal as we stay in Canada more they 3 year out of last 4 years.
but my son lived in canada just for 1 year, 6 months, 3 days including the end date.

I put my file on February 6, 2013.
process start on February 13, 2013
Transferred your application to the local CIC office on March 22, 2013.

What are the chances for my SON PR renewal? what are the recommendation you suggest at this stage?
