Hello,

I am a Canadian citizen and my wife is US citizen. I sponsored her and she received her PR in 2009, and her PR renewal is in 2014. In Dec-2012 we moved to Asia (to pursue better opportunities) and declared non-residency to CRA. Now my wife is planning to move to US (she feels that US would be better for her career), whereas I will continue to live in Asia.

Question:
1. Will she be able to renew her PR since we are both non-resident and reside in different continents?

2. Where can I get concrete answer to my above query?

3. What do you experts suggest?

In order to maintain her PR status she must live in Canada for 730 days out of every five rolling years. Any days spent living with you outside of Canada count towards this 730 day total since you are a Canadian citizen. The days she spends living in the US while you are in Asia do not count since you are not living together. She must be living with you in order for these days to count towards her PR residency obligation.

So the answer to your questions are:

1) She will be able to renew her PR card this time around but will face problems next time if you are no longer living together.

3) She needs to spend at least 730 days out of every file rolling years living with you (or you living with her) in order to maintain her PR status.
 
1. She has lived 850 days in Canada (with me) since her PR. Also, even if she moves to US, my work permits me to stay 4-5 months (every calender year) in US. Problem will be how will she prove to CIC (on her next PR Renewal) that we both lived more than 730 days in last 5 years, if I just visited her in US as a tourist?
