PR Renewal applications - are these linked?

Hi,

My PR renewal application is in process and is delayed for more than normal. During this time, my spouse PR renewal is now due. Is it advisable to wait until mine is cleared before applying for my spouse PR renewal. Is it that these two applications will be linked in any way or these are treated as independent of each other? Will my pending status affect renewal of my spouse PR application. Any suggestions, advice is highly appreciated. Thanks in advance.

Each application is in theory independent and processed on the basis of the applicant meeting the Residence Obligation. In practice where there are residency concerns then applications of other family members are scrutinized in more detail - without knowing more about your circumstances hard to give a more conclusive response e.g. is your spouse full time employed with proof in the 730 days required with no travel?

Yes, my spouse is in full compliance of 730 days plus just a few days more, full time employment only for last three months in our own 3 months old incorporation, prior to that LINC attendance records are available for about one year, also currently enrolled in LINC classes.

Our daughter's PR renewal is also due and we plan to apply both the renewals together, as daughter is a minor, she has all the school records for last 2 and half years. All our PR cards have expired around mid of last year. Regarding travel - yes twice a year we have travelled out of Canada during last three years for a duration ranging from 2 weeks to 2 months maximum.

Hope this provides some background for inviting any suggestions/ advice.

In my opinion it won't make a difference when spouse applies subject to meeting the 730 days - self employment as is the case here given its for your own incorporation can be a red flag on the basis that its easy to hide absences than if you were employed by a 'regular' company e.g Walmart as say a cashier for 40 hours a week. CIC will be looking at taxes filed. LINC doesn't always require attendance so another red flag. In your shoes I'd get ready for an RQ by obtaining proof of physical presence - provincial health billing is an example as it will show claims made by medical practitioners when you get treatment. Unless someone pretending to be you went for the MRI/ X-rays etc then its good proof you were in Canada on the treatment day.
