PR renewal application delayed...please help

Here is briefly my case.

1.Landed in March,2008.
2.Spent 3 years out of Canada before moving in March,2011.
3.Applied for PR Card renewal in December,2012 (Didn't wait for 730 days---mistake)
4.Application got transferred to local office in January,2013. It is pending there since then.
5.Urgent processing request with tickets got rejected.

What is the best course of action now?
Wait until I hear from local office or withdraw the application and reapply as I got enough number of days now by the end of March,2013.

Please let me know.

I would withdraw and reapply since you were well short of 730 days when you applied in December.

Hi Scylla, I have a few questions.
1. I have 740 days now, if I withdraw my application today, how long should I wait before reapplying? Do I need to wait for confirmation that it is withdrawn?
2. What are the chances of getting transferred to the local office again and getting delayed?
3. I called CIC call center and he said if I reapply, it may end up being transferred to the local office and that I would be just wasting my time by reapplying. He also said that the outcome would be same even if I reapply. Is he right?

1. Once you are sure CIC received withdrawal application then you can re-apply. The definitive confirmation is when CIC confirm your withdrawal in writing but since you seem to be in a rush to get your PR card you could go with when CIC receive your letter - mail it registered or courier.

2. No one knows depends if CIC believe your new declared days and have no need to carry out further checks. If you are in a rush to travel you can apply for a Travel Document to return to Canada.

3. If you can prove 730 days you will get a renewed PR Card since the law says CIC must only look at the 5 year period prior to application- effectively this is a loophole for those in breach of the Residence Obligation who manage to get 730 days before CIC reports them. Now getting the PR card when you want it is a whole different ball game...CIC will process it as routine or non routine.

Today I received the form 5511(Questionnaire:Determination of Permanent Resident Status). They asked me to submit ICES traveler history as well. Is it because I applied before 730 days? I am very disappointed with this whole thing, Can I still withdraw the case and reapply as I have well over 730 days now? In that case, can this just be ignored? VIP members please help.

Yes - you have received this request because you applied to renew your PR card before you met the residency obligation. As was explained to you above, it is impossible for any of us to say if CIC will allow you to withdraw your application or not. They might allow you to withdraw or they might not. You can always try and see what happens.

I would not ignore the request you have received now. You either need to respond or try to withdraw your application.

If you ignore this CIC will consider the application abandoned and eventually close your file but who knows if this is in 6 months, 12 months etc. Better to be proactive and formally withdraw then re-apply. CIC may ask for the ICES traveller history even in the second application so get this to save time if they do require it. Don't wait for the ICES history though go ahead apply if you have the 730 days.
