PR Refused Reconsideration !!!

Hi All,
I need some help here. My PR is recently refused. My immigration agent while creating my express entry profile entered my IT related NOC as primary (where I have almost 9 years of experience) and my skilled work experience in construction which is over 6 months but less than 1 year. So, I got invitation to apply a few months before in category based draws for skilled trade (based on my atleast 6 months of experience in construction). However, while filing my PR, agent switched the primary NOC as for the construction where obviously I have less than 1 year of experience. Now, I received a refusal where the below is mentioned:


I am not satisfied that you meet the requirement(s) under paragraph(s) a) because you have not submitted
sufficient evidence to satisfy me that you have at least one year of continuous full-time paid work
experience, or the equivalent in continuous paid part-time work experience, in the occupation identified in
your application as primary.

Can anyone help me here. Will a reconsideration work here if my agent sent an apology letter saying that its a mistake on his behalf?

You can certainly try.

Ultimately IRCC holds you responsible for the informatio in your application, even if you use paid advice.

However no harm in trying. Good luck.

IT noc is 21230. This was primary on my profile before ITA but after ITA construction noc code starting with 72xxx was made primary.

While filing for pr we should list all work experiences, the officer checks all the work experiences for eligibility. Did your agent only list the construction work experience?
did you provide work experience documents and paystubs for both ?

Can you log into your profile and check the list of documents submitted? Look for the ones under work experienc.

See this was the reply of the IRCC officer:

I am not satisfied that you meet the requirement(s) under paragraph(s) a) because you have not submitted

See the bold one, he has mentioned that in the primary NOC (which is for construction), 1 year of experience is not there. So, I think the rejection is due to the primary noc code should have been the IT one (21230) not the construction one.

It is basically category based draw for which my profile was pickup for.

Whats your take on this?? Does, it matter?

I believe you should definitely give it a try but my advice is ACT FAST! And if you could reach out to your local MP too. But hurry, hurry, hurry! I was in a similar situation and waited for 3 weeks before taking action which resulted in rejecting the reconsideration. I am not sure if your agent is good enough to handle requesting a reconsideration, but I would also recommend working with a professional (either a lawyer or CICC registered consultant.
