PR Question: Risk of going back to Canada

Good Day! I have landed Canada in December 29, 2010 and my PR will expire on October 5, 2016.

Should the residency obligation requirement is prudently calculated its 730 Days counting backward from the date I landed, certainly I have to be in before December 29, 2015.

I am out of the country settling very important matters, but to abreast with residency obligation.

Is there any risk of getting back by 2nd week of February 2014 notwithstanding the fact that I have accumulated stay in Canada for about 80 days only?

I am opt to stay there with my family for good. Kindly hear my apprehension the soonest. Thank you very much!

You can enter canada without a problem before your PR card expires. They might ask why you were out- say you had important family matters to settle. They cannot stop you if your PR card is still valid.

The problem is not whether or not the OP can enter Canada. As a PR, he has the RIGHT (not privilege) of entry. The problem is whether or not there is a risk in entering Canada after the OP is no longer in compliance with the residency obligation, and the answer is, yes, he may still get reported at the entry for breaching the residency requirements and be let in at the same time (30 days to appeal, losing the appeal means losing the PR status). And this has happened to several people, even though they had valid PR cards.

To be safe, try to be in Canada BEFORE December 29 2013 (yes, 2013, not 2015) and do NOT leave Canada at all for 731 straight days. You need to be in Canada for two years (or 731 days) within the last 5 years. If you have been a PR for less than five years, you will need to be able to accumulate 731 days within your first five years, so the most that you can be out of Canada within the first five years is three years (or 1,094 days). You're almost running out of time that you can be outside the country, so you had better come back as soon as possible (and stay put for 731 days without leaving at all) to ensure smooth entry into the country.

EDIT: I just noticed that you have accumulated about 80 days in Canada so far. If you can document these days, then it's probably perfectly safe to come back about 70 days after December 29 2013 (or last week of February 2014).

You are ok with your plan subject to getting the 730 days. Can you prove the 80 days you have been in Canada? Issue won't be at entry but likely PR Card renewal..if you can't prove the 80 days add then add these onto the 5 year window in 2016 then apply for PR Card. Also since you leave no margin you can't leave Canada for 731 days...multiple posters on the forum have found this to be tough when an urgent travel need has arisen e.g sick relative.
