Hi All,

I know this question has been answered before, but still I have confusion. My wife landed on June 4th, 2019. We spent 3 weeks in Canada then we left back to the Middle East. Due to corona virus, travel restrictions and other personal issues, we still yet to go back to Canada to settle (hopefully very soon).

What will be the deadline to go back to Canada without being reported by the CBSA officer?

If you want zero risk of being reported, then you would need to return before you have been outside of Canada for three years. So sometime in June 2022.

Hi Scylla,

Thanks for the info. I am a Canadian citizen (also the sponsor) and my wife is the PR. Does this change your answer above or still I have to be in Canada by next June?

Yes you still have to return by June. Since your wife never resettled in Canada you can’t count your time abroad together towards her RO.

I'm going to add a warning that targetting returning just before the anniversary that means still in compliance - 'cutting it close' is NOT the best strategy.

If your spouse has effectively never lived in Canada - and presumably friends, family not in Canada either - what are the chances that residing in Canada without leaving at all will be acceptable? What if something happens that means she needs to travel home?

You really should consider returning earlier to have some buffer for contingencies and emergency travel (let alone just a vacation or three).

This board is replete with such cases - planned to return earlier, something came up, returned with small buffer, something came up, now out of compliance and [any number of minor to major problems for inconveniences to serious difficulties follow].
