Dear Members,

Please give me your advices for my urgent situation.
I am in Canada but I have to leave to original country because I don't have enough fund to stay here and I could not get a job after 6 months. I also need to have an operation that need to be done as soon as possible. I am really stressed now.
If I leave Canada now, I will not meet 730 days rule because I have been outside 3 years and now if I leave I will be outside for more than 3 years.

1. I got a exempt passport and I got Electronic System for Travel Authorization. Can I leave CA through US land border using my exempt passport and ESTA? or what is the best way for me to leave now?

Hi Members,

If I get out through US land border, will my leave be recorded at any system?
If I have an exempt passport should I come back through US land border when my PR card has not expired yet.

1. Why go through the hassle of travel via the US and deal with CBP if you don't have to? Oh I see you think your absence won't be captured...sorry the days of slipping into the US before proceeding to a 3rd country to 'hide' Canadian exits are long gone. CBP and CBSA now share data and when CIC see US entry stamps they will ask for CBP records.

2. Just travel to wherever you need to go to and deal with CBSA when you decide to return to Canada. You may or may not get reported at the Canadian border depending on what you tell the agent and if he/she decides to investigate your declaration.

3. Why can't you have the operation in Canada..oh yeah its an after thought as you can't get a job which really is the reason for your absence. Surely if it was that serious you would have had it in the 6 months you've been resident. You can bring the operation up as a H&C ground if you get reported. By the way job search for 6 months won't fly at any immigration hearing..its not a long enough period.
