Hi,
I was wandering if after my current work permit expires I'll need to renew my work permit. My PR is in process. What happens if I can't renew it?

If your work permit does not renew, you need to leave the country. However, if you receive medical request and completed medical, then you can renew your work permit. If you get your PR, you can come back. At this point, it is better to seek ways to renew your work permit. I would advise not to overstay, that will affect your PR.

Sorry, I'm confused, what about the implied status? My medical exam was already received by CIC, so you say that with this I won't need to leave?

Also, with the medical I can renew my work permit without an LMO? I also understand that if I leave the country my PR process ends...

Once you have an application with cic, you have implied status until a decision is made on your case. There is no need to leave the country when no one is chasing u.

Like I have said just stay where you are the only catch is that you are not eligible to work during the periods after your work permit expires.

You need to have valid work permit or resident permit to stay in Canada legally. I presume you have applied under FSW category, then if you have medical done. Renew your workpermit online using medical receipt i.e. medical form signed by your physician.

If you stay illegally, you can not get your PR. You can restore your illegal stay upto 90 days, but it is expensive so renewing the workpermit. My advise is not to stay illegally.

If you are other then FSW category, then the story could be different. I am not familiar with life and care give category. Please check CIC website.

1. One has to have a Legal status in Canada for the PR application to be successful. Legal status can be a WP, Student permit or Visitor Permit.

2. One has to apply for "Extension of stay" either as a worker, student or a visitor before the date of expiry as noted on the respective permits. After the application for Extension of stay (to Vegreville), you will be on IMPLIED STATUS till you get a notification from Vegreville.

This is also a Legal stay and your PR application will still remain VALID.

If you fail to do so within the "Date" on the permit then you will have to apply for Restoration of status with valid justification. You have to apply for Restoration of status within 90 days of losing your legal status. There are additional fees for it.

So I can apply for a new work permit without an LMO if I have my medical receipt? Yes I applied as a FSW.

Last question, my receipt was never "signed by the physician" it is just a receipt showing the amount I paid, name of doctor and place. Is this valid too?

You need to submit the receipt i.e. copy of medical form that is signed by the doctor (with your photo on it, sent by CIC/VO for medical request). This is called medical receipt (it is not the actual receipt). Good luck.

When you fill online form, you are required to fill few questions. It will lead to submit a medical receipt. Then attached scan copy of it. Then submit it. Then you are in implied conditions until you hear from them. By this time, you will have your PR visa!!

Thank you Bp, but I never held in my hands this receipt, this was kept by the clinic that performed the examination. Is it possible to request it somehow? Please excuse my confusion.

They normally give you a copy, your best option is call CIC. Please note that CIC has database they can always access all your info. They can verify it quickly. At this point, you should apply open work permit by indicating that you have done medical. Include your medical receipt (one you have). It is always nice to write a cover letter explaining situation so that immigration officer would make the best decision or look for additional info. Also, if the immigration officer needs more info, they always can contact you!! My advice here to you is: pay the fee and apply extension for the work permit by using your medical receipt.
