PR: I have a common-law partner, who can I sponsor?

Hey All, Happy New Year.

Looking for some guidance, I've seen a lot of posts from people whom are alone / do not have spouses in Canada.

My girlfriend (common-law) and I both became PR in Feb 2016. She was listed as a dependent on my application, we're both originally from the UK and have no family here.

After reading the above, I'm confused.

Both of my parents are alive, and my girlfriend's mother is alive.

I would love to sponsor my brother for PR or my father. But because I have a common-law spouse it doesn't look to be possible?

Hi, you cannot sponsor siblings if you have relatives in Canada and your parents are alive. But you can sponsor your father if you meet the financial requirements.

Thanks for the quick reply. I do not have any relatives inside of Canada. Does that make any difference? or does my common-law girlfriend count as a relative now?

Your common-law girlfriend is a relative.

Even if you didn't have a common-law partner, you couldn't sponsor your siblings because your parents are alive. Only way it would work is if your brother is a dependent of your father.

You can't sponsor your brother.

You can only sponsor your father once you have 3 years of Canadian tax returns completed meeting the necessary income level.

Yes both incomes will be counted. Check here:

Look at sections:
- how to calculate the family size
- Minimum Necessary Income requirement for sponsors of parents or grandparents

Note that you can only combine your income with your common law partner's income if your partner in law's income was earned in Canada and your common law partner can provide Canadian tax return statements.
