PR for US born baby

Hello,
We are planning to move to Canada from the US in June as Permanent Residents. (Our PR's are valid till end of August and we have stayed in Canada for 3 months over the last few years).

We wanted to move sooner but we are expecting our second baby in April and the doctor advised us against moving during the pregnancy due to some complications.

I wanted to know if we can bring our new born on his American passport and then apply for his PR once in Canada since we will only have 2-3 months after his birth or do we need to follow any other process.

Also, will one of us need to stay in Canada throughout the application process as in what if I need to travel to the US for a couple of days.

I am in similar situation and this is my understanding.

You can take your newborn to Canada as visitor on US passport.

You can sponsor your kid once you are in Canada. Process will take around 9 months.

At lease one of the parents will need to maintain a residence in Canada while kid's PR is being processed though it's fine if sponsoring parent(s) is out of Canada for couple of days/weeks while PR is being processed.

First, your PR does not have an expiry date, only your PR card. In the past 5 years, how many days/months have you lived in Canada? Do you meet residency obligation of 730 days in the past 5 years?

Yes, we will meet RO. We have stayed in Canada for 3 months in the last 30 months, so we have uptil Aug 2018 to. meet RO.

My concerns are if there might be issues bringing the infant on his US passport while we will need to get the goods to follow forms signed etc and although we will be residing in Canada moving forward I might need to travel to the US for work.

Based on previous response it seems these shouldn't be issues.

Do you'll recommend getting in touch with a lawyer or agent or is it standard procedure.

You have less time than you think. It doesn't matter when your PR cards expire. What matters is when you landed and became PRs. You must be able to meet the residency requirement based on this date.

I am not sure I understand, Let's say we became PRs on May 15, 2015 and have stayed in Canada for 90 days, will we not meet the RO if we move by June 15, 2018. Our PR cards expire in August 2020. According to my calculation we would have around 60 extra days to travel over the next 2 years after moving to Canada without putting our RO in jeopardy. Granted it's not ideal but we would be following the rules. Let me know if I am miscalculating.

What I'm saying is that you should not be calculating based on the date your PR cards expire. This date is irrelevant. All that matters is when you became a PR. This is a mistake people often make which leads them to believe they have more time outside of Canada than they really do. You still have time - but possibly not as much time as you think if you calculate based on your PR card expiry date.

Yes, I understand. There is a 3 month difference between date of landing and PR card expiration date. I am calculating based on date of landing and having accrued a few months already will save me. But thanks for the heads up.

Can you advise about new born traveling on US passport and sponsor being able to travel for a few days while the application is in progress.

Yes - one of you will need to remain in Canada and live here while the PR application is processed. Assume 6 months processing time.

Occasional short trips outside of Canada (e.g. 2 weeks) are OK. I would avoid leaving for longer and make sure these trips are kept to a minimum. Certainly the sponsor should be spending the vast majority of his/her time in Canada.

How you are managing medical coverage of baby ? Also did your baby got PR card now .

Please help as what i see in thread medical is not covered and for baby we might need to visit doctor regularly so whats your suggestion .

Also after applying PR for baby , is it mandatory for baby to stay in Canada , or my wife and baby can travel back to home country and i can stay till
we get the PR card for baby,

The child is not required to be in Canada at all during the process.
