Respected members
May I request urgent advice. We got PR in 2005 but My parents could not complete residency obligations due to domestic issues and our PR expired in 2010.. That time I was child. last month I turned 18 and want to go to Canada to study in university and want to get my PR again. Just to mention my parents have applied for renewal for all members since 2 years but it is under review and taking long time and might not be renewed.
I want to join university.
Pl advise what should I do.
Can I apply alone,
what are my chances to get PR for me.
How should I apply.
Will I pay fee same as international student or resident.
Appreciate valuable advice from all valued members.

Waste no time and apply right now for a PR travel document based on having been removed as a minor and now wanting to return. If you get it, you can return to Canada alone, renew your PR card and enter university as a PR and pay PR tuition fees.

You are right in thinking that your parents PR is unlikely to be renewed.

She is a minor whereas you are not a minor anymore in some provinces and not according to immigration. If you apply together where you say you will act as her custodian, it could help your application as immigration may think that you are more committed if you go together. Or she can wait until she is 18.

If you get your travel document, keep in mind that you must be committed to staying for 2 years to make sure you meet the RO. A travel document can only excuse you from not meeting the RO in the past, not in the future. If you renew your PR card and then leave again, you could get reported for not meeting the RO.

If you get TD, first you have to return to Canada. Then you can apply to renew your PR card based on having been given a TD. It will take at least 6 months to get it.

After getting your PR card, you could take short trips outside Canada but be very careful because if you happen to be outside Canada and your PR card is lost or stolen and you have to apply for a TD again, immigration may not be so happy to give you another one because they may feel that you are not serious about settling in Canada if you are going back and forth.

The best reason to give to get TD is that you were removed from Canada as a minor and did not have a choice in the matter and now that you are 18, you are serious about returning to Canada to settle. If you get accepted to a college in Canada, it could help show your intentions.

It used to be pretty much guaranteed to get a TD if you were a removed minor but this has been changing recently. Now in some cases, they rule against you depending on a number of things. I suspect that one of the points they are now looking at is how much time you spent in Canada as a child or how old you were. Surely someone who spent 5-10 years in the Canadian school system and was then taken from Canada by their parents has a much better chance at settling and is more likely to be serious about it than say someone who only spent a month or two in Canada when he was a small child. However, it is in your favour that you are applying at a young age because it is a criteria for removed minors that they apply to return as soon as they can.

Dear Mr.Leon
One more clarification please. How I should proceed. As I explained earlier, my parents application is in process in which my application was also there as minor child. Now Should I withdraw my application or parents shall withdraw their application first. How I should proceed for me to apply as independent applicant and how long it will take approximately for me to withdraw, apply separate and getting TD and PR after landing on TD.
appreciate your response.

I don't think there is any harm in applying at the same time as you withdraw yourself from the application made by your parents. A TD processing times depends on the visa office. In some cases it can take months. A TD is usually valid for about 6 months so that's how much time you have to pack up and get to Canada before it expires.

Dear Leon
one more clarification please, what application should I use to renew my PR for separate applicant (minor to independent). Will it be normal renewal application or there is special application for that and what justification shall I write to keep my case strong.

You are not going to apply to renew your PR card yet because you can't apply for that from outside Canada anyway. You should apply for a TD, see http://www.cic.gc.ca/english/information/travel-document/

You should write that you were removed as a minor and are returning first chance in order to settle in Canada now.

If you get the TD, you return to Canada and then you can apply to renew your PR card using the regular PR card renewals forms.

If you are granted a travel document and use it to return to Canada, you can apply to renew your PR card right away.

In that case PR renewal takes how many days. Now a days PR takes around 170 days for renewal.
In that case, the PR renewal will take 170 days or a bit shorter or longer depending on which way the processing time develops.
