PR extension for Minor Child

Hi Guys,

PR holder parents living abroad, want to send 15 year old child to study in Canada (her aunt will be the guardian for the time being).

Question is, will the child be able to apply for PR extension on her own? Do parents absence affect the application?

1. Yes, she can apply, her guardian will have to sign the application. Parents status is not a consideration, as long as she meets the residency requirements.

Hi, I have the same issue. My son 16 y.o. has been studying in canada for about 2 years while we ( parents ) are living outside canada . That was actually a goal to keep PR status for him . But now I want to be sure that there is no risk to loose status in case parents will not be able to keep it. Could my son apply for PR card renewal without us in canada? Is there any reference to official documents I can rely? Thank you very much , tatiana

Your son will not lose his PR status if you lose yours because he is in Canada and meets the residency obligation.

As for official documents, here is a quote from operational manual 10 which has to do with travel documents and residency obligation:

Although a separate form is required for each applicant, it is generally desirable to process a family unit on a single file in CAIPS. Processing spouses and children together on the same file facilitates easy comparison of the information provided. Should some family members meet the residency obligation while others do not, the latter should be removed from the common file and processed individually on separate files.

In ENF 27 at http://www.cic.gc.ca/English/resources/manuals/enf/enf27-eng.pdf which is about permanent resident cards, it is also mentioned that PR cards are applied for individually and that if an individual passes the requirements, they get one.

Each person, including all family members, must apply individually, in accordance with the following instructions:
 a permanent resident 14 years of age or more must sign their own application;
 parents or legal guardians sign for minors under 14 years of age; and
 an application for a PR card shall be made in a form prescribed by the Minister.

Note: If, following the CIC investigation, an individual is found to be genuine, or otherwise meets requirements, the CIC will return the application to the CPC-PRC with the appropriate advice that a five-year card may be issued.
