Hello everyone, it's almost a year, today I got back to this forum, with some hope. Myself, my wife and my son, we all landed in Toronto, Canada on Sept 25, 2008 and returned back to our base country after staying for 21 days. After 8 months we got our PR, SIN cards. We stayed and planned to go back by 25 Sept, last year by terminating my well paid job in Qatar, but we didnt go and overstayed till date. Recently I heard that the company I work for is laying off some staff and I am afraid about my job. My Q to all, is my chance to land in canada is still open. Can I go back at this point. Will they allow me to enter Canada ?? Thanks

You haven't met the PR residency requirements (living in Canada two out of every five years).

You can certainly return to Canada and you will be let into the country. However if immigration notices that you haven't met residency requirements, they could report you. If they report you, you will have to appear in front of a judge to argue why you should be able to retain your PR status.

If you are able to enter Canada without being reported, then you should live in Canada (without leaving for even a day) until you meet residency requirements - then you can renew your PR cards.

So the short answer is: Yes - they will let you into the country. However it's not possible for any of us to guess if you will be able to keep your PR status.

scylla, you said if the officer would notice that he doesn't meet the rules..now how would he notice it ?! how would the officer notice that he is out of the country this much unless he declare it on the declaration card ! or he has something on his system ?!

The officer MIGHT notice (this won't necessarily happen).

This information can come from declaration cards, from the stamps in the persons passport or from the immigration computer system. Immigration has access to some airline manifest information (i.e. airline passenger lists) through their computers. I don't know if they have access to the airline manifests for all airlines or just some (I would assume it's just some) - and for how far back. However I definitely know they have some of this information at their fingertips because my husband had an experience where they knew about all of his exits and entries even though he hadn't told them and didn't have stamps in his passport.

Scylla, I have filled wrong information couple of times while I am entering the country to avoid the questions .. now I am renewing my PR and I am truly good to renew it.. do you think those wrong declarations would effect my renewal process ?!

Sorry - I have no idea.

But you need to stop with the false declarations. CIC regards this as a crime.

no ..no .. that was couple of years ago before I moved for good.. and it was a mistake..That is why I feel bad !!:(

My husband got his pr on june 2007 and he stayed there for 6 months in canada and he got back to india in christmas holidays and he unfortunately met with an accident and have to go for ankle implants removed and he was under treatment for severe complication for his ankle.he was in india since the time he got back from canada.now his canada pr expired in june 2012. he came to dubai in sep 2012 because he got his pr in june 2007 from dubai and he is medical fit now with out any complications and he is planning to go back to canada. please suggest if he can get a travel document on H & C grounds , he has all the medical document for last 5 years of his treatment.he is planning to apply for travel document in abu dhabi
