Hi All,

We received our CoPR's recently,
Issue date 02/Feb/2023 and the Expiry date is based on our passports
our passports expiry on Jun/2026 and Feb 2027 for me an my wife.
So PR was not issued for 5 years but for the Passport expiry date

Regarding The Residency obligation rule is 730 days in 5 years,

My question is does the same applies to us? should we complete 730 days in our 3 and 4 years of PR expiry to renew it in the future? or would that be reduced given that our expiry date is not 5 years.
Not sure how this works

The Residency Obligation remains the same; 730 days in Canada for each rolling 5 year period. It has nothing to do with the expiry of your passport or PR Card.

You can typically apply to renew the PR Card, 9 months before it expires:

I am a Canadian resident and living in the US on h1b. 3 years have passed and I have now about 2 years left on my PR card since the landing date to meet my residency obligation.

If 1.5 years is left for me to meet my obligation, can I still move and renew my PR card 6 months after?

The short answer is...maybe.

You will be allowed to `enter' Canada, but...If, when you seek re-entry into Canada you have less than 730 days in Canada (looking back 5 years on the day you enter), you could have an issue with CBSA.

Because you are currently (or soon will be) out of compliance in meeting/maintaining your Residency Obligation of 730 days `in Canada' in each rolling 5 year window, you should be prepared for questioning at the very least when returning. If,when you seek re-entry into Canada you have less than 730 days in Canada (looking back 5 years on the day you enter)

When you present yourself to a CBSA upon re-entry into Canada, the officer may issue you a report [(44(a)1] for not meeting the R.O., which could lead to your PR status being revoked.

Be prepared to answer questions and hope that you end up being one of the lucky ones that gets through with little, or no questioning.
