Hello all:

I am looking for some help with my situation. I got my PR done in Dec 2007 but in the last 5 years I have only spent 10 days in Canada since. I went to grad-school in States and then took a job in the US. I am looking to relocate to Canada but I am not sure if I can do that before Jan 2014 due to work related commitments.

My PR card is going to expire in September 2013 and not having met my residency obligations, I am trying to figure out a way to get my PR extended. Is there a way to get an extension on my PR with my situation?

only way you can avoid the situation is come to Canada, stay here till you meet the residency obligations, let your PR card expire, but apply only when you meet residency obligations. If you come to Canada & apply for PR card they may reject it & you will loose PR status.

Are your work related obligations more important than your PR? If the answer is yes, stay in the US, if no, you still have a chance to save your PR.

If you go to Canada before your PR card expires, there is still a chance you may be reported for not meeting the residency requirements. If that happens, you would have to appeal for your PR and you may lose it. If you don't get reported, you can stay for 2 years straight and then apply to renew based on that you meet the residency requirements again for the 5 years previous.

If you try to go to Canada after your PR card expires, you might still get away with it but the odds of getting reported on entry would be greater.

Studying or working in the US is generally not a good excuse not to meet the residency requirements.
