This is my second post in this forum..in first i hav mentioned that i got seperated from my wife and seperation will be of one year on 1st july 2015..i came to canada ti live with her but she refused to meet me n did not even allow my 2 year daughter to meet me..devasted and heart broken i left canada after 3 months...my PR card is with her..now from india i have hired a lawyer in canada and want to appeal in CIC..and i want to come back to canada ..because i left everything here in india to be with her..
My lawyer has assured me that he will certainly help me to get my PR card back.obligation 51 has been written on my landing papers ..but i want to make a mercy appeal and let everything come to light in front of CIC..atleast its my right to meet my daughter atleast once ! Will CIC look at this matter from my perspective ...will help me and let me know what can i do further?? Thanks a lot..currently i am in india from last 8 months

As a PR, you go the nearest Canadian visa office and apply for a PRTD (Permanent Resident Travel Document). This is how you get to Canada. Once in then you follow the law on how to see your daughter.

I am not sure what your lawyer is talking about when he want to "help get your PR back". You did not lose your PR status from the first place. If he is telling you he will get you your PR card back then fire him right away. First, he can't. Second, there is no point.

He is talking about my PR CARD..which is with my wife..i dont know if i can travel back to canada without that

Ok..i got your point that i need only Permanent resident travel document to travel to canada even if i dont have my PR card wigh me which is valid for 2 years..i think if i sound right !!! Thanks a lot

You need PRTD to board the plane. Once in Canada you enter as a PR. You don't need your PR card. Once in Canada you ask your wife to give you your PR card. If she refuses then file a police report and report her.

If you have a child with her then the PR shouldn't be conditional.

You can also apply for a new PR card once you are in Canada.Tell them you lost your old one.

Not bad idea, this will give you way to talk to her. But first apply PRTD through Canadian Embassy in India, send them all the details and proofs that you have as Resident of Canada. You would get the PRTD possibly within a month.
