What about your 2 yo. daughter has prevented you from residing in Canada? As far as I can see, you are far from meeting the residency requirements. If you want to appeal that, you have to have some H&C reasons for why you could not meet the requirements.

Yes, children of PR's are often denied visit visas because of that. What you could have done was to go to Canada alone to make sure that you would meet your residency requirements and while there, you could have sponsored your child and husband for PR. You could also have applied for a TRP for the child to come with you.

So you did not know that was an option, maybe nobody told you that was an option but at the same time, you have let your PR slip through your fingers because of the residency requirements.

Leon, I checked about TRP as well with many lawyers and I understand that TRP is given only at USA-Canada border and in my case they said since you lived in Canada for very less time they will not give you TRP for your daughter, can you please guide me now in this situation what should I do now to renew my PRC and the sponsorship my PRC is expiring next year October, please advice.

Well, whatever you could have or should have done back then is a moot point to discuss so you have to figure out where you go from here. You can not renew your PR card outside Canada. What you could do is go to Canada now and see if they let you in. If they catch you and realize that you do not meet the residency requirements, they could start proceedings to revoke your PR and you would be able to appeal that. If they just let you in and don't say anything, you could start proceedings to sponsor your husband and daughter and see if they question your PR status at that point. Maybe you will get away with it. It would however mean being separated from your family for a few months.

hi leon,

I've just read this topic , iam also residing outside canada am a permanent resident card holder. I have read that if you are working
with a canadian business outside canada your days are counted in canada. By this they mean any canadian business , and how
can we find out that what canadian firms are working in our region of stay.

I wanted to take my daughter to canada as well for applying her in canada immigration but I was also refused a visa.
is there any way that I could get a TRV , embassy said that they are not satisfied that my daughter would leave after her stay.
what proof can be given for a three year old child except for her school admission record.

can you help suggesting something for me.

As you a PR holder, you don't need a TRV to enter Canada. You need only your passport and valid PR card.

nad: You would have to have been employed by a Canadian business and have been transferred to another country to be able to count your days. To sponsor your daughter for PR, you can try to get a TRP for her if she is denied a TRV. Other people in the same circumstances have been issued TRP's for their children. The other option is to leave her behind while you go to Canada to sponsor her.

destinationBC: the residency requirements for PR state that you must live in Canada for at least 730 days in your first 5 years as a PR and each rolling 5 year period after that.

hi ,

@ leon , thanks for the reply . I have talked to lawyers about the TRP but none gives any hope. Do you think that in my situation
my daughter will be able to get it.

Please tell me how is this possible.
thanks.

You should be talking to the embassy about it. How can you know if you will get it if you do not apply?

Leon you mentioned about TRP, as I understand that it is given only in Canadian embassy of USA or we can apply in any other candian embassy I live in KSA, please advice.
