PR Card Renewal Process Got Complicated - what are my options

Dear All,
I landed in mid of 2008 and stayed on and off for one month periods till 2011. then I came for good and settled in with my family by end of 2011, I working for a Canadian company. kids are in school
my issue is that when my PR was to about to expire in July 2013, I applied for renewal in May 2013 and submitted all the documents but struggled to proof my first three months of stay as we lost our travel documents in 2009 and got new ones which we are still holding till todate.
when i submitted my PR renewal application, CIC came back to me and asked for my travel document for this first period and if not then the police report for that loss case. i replied back to informing that i didnot keep any proof which was stupid of us, however i requested them that as of today i have already spent the 730 days if i discard that whole initial period which i cannot provide proof for.

I called the CIC to ask about the status and the agent informed me that my application is under special processing and she cannot estimate when it will be completed.

the interesting part if I reapply today, i will be able to submit all documents 100%

My question, Can i withdraw my application and if yes, is there any implications? that can affect my new submission by any means?

Withdrawing your application, won't do a thing for you. CIC knows or suspects that you didn't meet your residency requirements and have started to investigate. Just because you withdraw, it doesn't mean the investigation will stop.

there are two options
if i withdrew, then reapply again taking the recent 2 years to be counted, would they still reject it because i could not submit proof for these 3 months 5 years ago.

Options
what is the worst case, can you they come back and reject it. Then i can reapply again.

In all cases i am already settled in working and kids are in school so we are going nowhere.

Just to be clear about your situation... Did you have at least 730 days in the last 5 years by the date you submitted your PR card renewal application in May 2013?

If you didn't have at least 730 days when you applied to renew your PR card back in May 2013, you better withdraw your application.

If you have at least 730 days back in May 2013, then just submit what CIC is requesting for, that is, the police report of loss of passport/travel document.

From your post above, it seems you didn't have at least 730 days when you submitted your PR card renewal application and is only saying that today, you have already 730 days...

Please clarify...

The worst case is that you are reported for failing to comply with the residency obligations, you lose the appeal and you have to leave Canada. If you don't leave, you are forcibly deported... Just so you know....

apolgies for confiusing you

i have stayed the 730 days when i applied in May 2013, my challenge is that i cannot provide the police report as i never kept a copy of it (which i regret not doing). Now from the CIC agent, it sounds like they doing some investigation, which can take a long time.

my query, was instead of wasting time with them going into these investigations which might take long, i want to see if i withdrew my application and submit a new one, i can be done in 88 working days and then i would be able to get my PR and travel around.

I am just looking to all this from a timing perspective.

I see...so you have at least 730 days when you submitted your PR card renewal application back in May 2013 but cannot substantiate it because you lost your old travel document... Even if you truly lost your old travel document, CIC could be suspicious about this so they are asking you to submit a police report pertaining to the lost and maybe they are starting their investigation on your residency days.

So, I think the better thing you can do right now is to withdraw your application and hopefully they will not continue their investigation into your residency days.

Please update us on this okay?

Hi HELDIN,

I think little different, why not you send your remaining documents to CIC and let them complete the process. I think once their documents completed they will start processing your card (as you have 730/5 yr).

But take couple of more advices/ inputs before you decide.

Seniors/ experts correct me if I am wrong.

I think you are better off applying to withdraw and see if they will accept it. If they do, wait a couple of months and then apply again.

I would simply apply for another copy of the police report to submit to CIC as requested.....

Just thinking, what could be the solution for this guy, if he lost the passport as well the report then how he can get the new report, unless he has a copy of that report. He cannot go back to same Police station as his PR card expired (taking risk of TD would be too much). To have new report he would have a new date on it, may be passport office could have his old report save in file and scanned but is not easy to get from under developed countires.

thank you all for your feedback,
I think i will go with the advise of withdrawing my application and then reapply again, i will just go get a lawyer advise now to make sure, i send a proper reasoning and not risk my status, i am already settled in, bought a house and working and already have another child that was born here in the last two years.

I do not want to go through other documentation request as the gentlemen below mentioned i come from the middle east and things are upside down over there and no one will care about providing me police report five years ago, I was in a hurry initially when i applied because of my work travel requirements, however i have spoken to the management and advised them of my status and they were kind to understand and not give me a travel requests for the coming period of time.


Last advise for withdrawing the applications, is there specific a format to use and how much details should i provide.
