PR card renewal after getting Married?

Hello guys,

I'm a PR heading back to canada in a couple of months with a PRTD (never had a card, became a PR about 20 years ago, left the country and recently won a IAD appeal under Humanitarian and Compassionate grounds) and I'm rngaged. We're planning to get married after I get my PR card so I can travel back for it to my home country without any issues and apply for a spousal sponsorship when I get back. My question is: Can I do this? Also, Do I need to apply for a new PR card after getting married? I'm not planning to change my name until my fiance/husband gets into canada lawfully.

Any comments on this would be of tremendous help! I have asked some questions similar to this before (sorry, just need as much advice as possible and everyone's so great here) so you can take a look at my posting history if you want more details on my case.

If you have just won an appeal and been allowed to return to Canada, in my opinion it would be foolish to then leave the country again until you have met your residency obligation requirements. You are subject to examination every time you reenter Canada and you might not be so lucky next time.

The fact that you get a new PR card does NOT mean that you can leave Canada and simply come back. The next time you enter Canada, they will check if you meet the residency obligation. You shouldn't leave Canada until you lived here more that 2 years PLUS the amount of time you want to leave Canada for (If you want to leave Canada for 3 weeks, you must have stayed here for 2 years plus 3 weeks).

You might also want to check with a lawyer but definitely do NOT leave Canada before clarifying this, otherwise all your hard work with the lawsuit will be for nothing.

Having won an H&C appeal does not remove the responsibility of meeting the residency requirements. I would strongly suspect that if you choose to leave again after receiving your PR, you would be subject to closer scrutiny when entering again, and potentially on the receiving end of another attempt to revoke your status if you make no effort to meet the residency requirement. There are obligations the PR needs to meet.

Reading this statement, it looks like you are planning to sponsor your spouse while you are outside of Canada after you get your new PR card? As a PR, you can only sponsor your spouse if you are living in Canada.
