Hello guys, I hope you can help.
My niece travelled a lot back home to visit her mom who is sick. She went back January 2013 & returned Dec 2015. While there she gave birth to a baby daughter on Sep 2013 by a caesarian. Baby had respiratory problems.Spent longtime on treatment & doctors visits & hospitals.
At the same time the husband who was a control freak didn't really want her to return to Canada. Never told her about the RO.
Now she has been living here in Canada since she returned in 2015. During this period she went to visit mom four times for a total of approx 100 days.
To renew her OR card VIC asked to submit documentation to support her long absence from Canada.
She is a single mom with three kids. She landed on Nov 2007kids are in school.
Any hope in this case? Would hiring a professional help?
Your advice will be really appreciated. Thank you.

All she has to do is wait until she has 730 days of residency in Canada over the last five years and then apply to renew her PR card.

How many days of residency does she have right now in the last five years?

Hi there thank you for replying.

The thing is she is planning to visit her mom once again in July for one month.
As far as the total days of residency I don't think she has 660 days.

If she returned to Canada Dec 2015 and since then only left for combined 100 days, she should have the 2 years required now to meet RO.

Or do you mean she already applied for PR card renewal, when she just had 660 days?

Her card expired on March 06 2018. We sent out the renewal application back on November 15,2017. Tuesday March 13, 2018 she received this letter stating that she had to submit documentation to account for her 2 years absence from canada (she left January 2013 & returned Dec o4 2015. Her mom was sick with a terminal disease, she then gave birth to her daughter who needed lots of medical attention [she has hospital docs for that] ).
I guess that's where the problem lies. Before she left Canada in 2013 she applied to renew her PR card. I had to mail it to her when it arrived in the mail.

I guess that's where the problem lies. Before she left Canada in 2013 she applied to renew her PR card. I had to mail it to her when it arrived in the mail.
She should have waited a few more months in Canada and gotten to 730 days residency, before applying for the PR card renewal. Since she submitted it with less than 730 days, I assume it's now gone for secondary review and H&C considerations, which may cause a massive delay in processing of many months.

As long as she submits ample evidence of her mom's and child's medical conditions (do doctor/hospital notes, receipts, etc) then there's a good chance the H&C claim will be successful. A lawyer experienced in H&C claims may be able to assist in putting the response together for best result, however it's entirely up to your friend if they want to spend the money on lawyer fees.

Thanks for your assistance with really valuable information.
That's what I thought when I read the VIC letter i.e. a renewal application based on H&C grounds.
Now my concern is she is planning this trip in July 2018. I am going to retain a lawyer to assist us with this file I just hope she can travel by then.

Returning to Canada she will need a PRTD. Could she be refused this document? Are there any guarantees she could not be granted this document?
She is travelling with her 3 Canadian born kids.
I would really appreciate your help as she is getting very nervous & restless.

Is there a phone number where i could reach immigration to inquire. The office handling her case in in Hamilton Ontario.

Is it really that urgent for her to travel.... travelling with an H&C application in progress is very risky..... trying to get a PRTD to come back is anybody’s guess....but that could pose a whole lot of challenges....... getting a PRTD can take as long as 8 months in some cases....

Does she currently meet the RO? If she doesn't, then yes, she could be refused a PRTD and they could begin proceedings to revoke her PR.

The trip is necessary it has to do with her mom's health as she is very sick & it could be the last time she would enjoy her alive.
Is there anyway we could reach immigration to see (if someone would speak to us of course) if we could be assuredfor sure of her getting a PRTD while her applcation is stilli

I have mentioned earlier in the posts above that she stayed outside Canada for 3 years due to her mom's sickness & due to the fact she got pregnant & delivered her baby in Morocco. We submitted all the necessary documents pertaining to her & her mom's ( doctors visits, operation in the hospita, treatment etc for her mom & then her own documents relating to prehnancy & the premature birth by caesarean, hospital stay, baby'treatment etc...
So she did not meet the RO but since she returned in Dec 2015 she has been here except for a 4 week trip last summer.
Would hiring a lawyer help this case?

Is there any chance your niece husband a Canadian citizen?
