Hi

can anyone help me with my calculations pls...

my pr is about to expire on nov 4th 2013 and i became a PR in oct 11 2008 and i want to renew it, but i cannot figure out how. Here are my dates travel dates

2008

NOV 20TH 2008(LEFT) - JULY 6TH 2011(BACK)
NOV 3RD 2011(LEFT) - DEC 9TH(BACK)
FEB 15TH 2012 (LEFT) - APRIL 52TH (BACK)
FEB 26TH 2013(LEFT) - MAY 6TH(BACK).

1) if my PR card expires before i accumulate 730 days, can i still stay on expired PR card till i reach 730+ days to renew it, provided i dont travel(which i wont)
2) how many more days extra do i need after expiry till i can apply for renewal?
3) Once i apply for renewal will it be an issue with immigration that i am only applying after my PR card is expired.?
4) when will i be eliglible for applying for citizenship?
5) Should i get a lawyer to do my PR renewal?
6) can anyone please recommend me a lawyer in GTA who is affordable. I live in brampton.
7) I havent done my tax returns since 2008 and i plan to do it this week. will it be an issue with immigration that all tax returns were accumilative and not done every year as they were suppose too?

Please please help.

1. Yes.

2. Your travel dates count as days within Canada so I calculate that you are outside Canada 1108 days in the past 5 years. You can not be outside Canada for 1095 days or more. Therefore, you need to eat up 14 days from your absence that started on Nov. 20th 2008. Therefore, the earliest you can apply is Dec. 4th this year. However, you should give it an extra couple of weeks and not apply until Dec. 20th or so.

3. No, they can only look at the previous 5 years from the application date.

4. For citizenship, you can have no more than 365 days absent in the past 4 years. You will reach that in Dec. 2014. Give it a little more time again and do not apply until January 2015.

5. If you want to.

7. It may well be that immigration will be suspicious about you really having stayed in Canada if you haven't been doing your tax returns. Were you working?

I was working from sept 2011-nov 2011, sept 2012-dec2012. And now currently still looking for a job.

Thanx Leon for your help.

what i dont understand is how do i calculate the days which i need to makeup at the end for eg. i stay 2weeks after nov 4th 2013 for fulfill the missing days, but since the rolling 5yrs moved outside the 5yrs, so the days i spent in canada during period oct 11-nov20th wont count? and since m gonna keep moving a days ahead in 2013 to fullfil these missing days now, so would that mean i need to re stay those 38 days first and then extra 2 weeks. ofcourse plus staying a bit longer to be on safer side. confused. woulld that mean i can only apply in jan end?

Right, because you stayed outside Canada for too long, you will have to make up for it.

As you are earning new days in Canada, your days spent 5 years ago will move outside the 5 year window so you are not gaining any days currently. This changes on the 5 year anniversary of your first absence from Canada because then the absence starts moving outside the 5 year window while you replace it with new days spent in Canada.

Yes, apply at the end of January. It is always better with an extra couple of days.

One question, one of the dates you wrote is April 52th? I calculated that as April 5th. If it was supposed to be the 25th, then you need another 20 days. If you do not apply to renew your PR card until January either, you should be good for both.

I am applying for jobs at moment...you think its ok for me to apply for government job openings?

If you are not applying for a job at immigration, I doubt they will examine your PR status. They may ask to see your card in which case you show it to them.

Hi Leon,

So its jan 2014 now, i was thinking for sending in my application for PR card renewal by 31st of this month as i have travel plans for may 1st returning on 18th may, you think i have enough days now? just to incase it helps i have been employed since Sept 9th 2013 as well.

here are my dates

Here are your days outside Canada according to Excel:

I start counting at 26.1.09 because that is 5 years from today and they only look at the past 5 years. You can actually subtract one day from each of your absences too because for PR, any part of a day spent in Canada counts so when you travel, you get both travel days as inside. However, you are ok not doing that because you are not too close to the limit.

It's not very long until May so I think you should ask for expedited processing to try to make sure you get your PR card before you travel. The normal processing times right now are 3 months so maybe you don't need to but it's good that they know you are planning to travel in case yours is for some reason delayed.

You don't need a representative.

ANOTHER thing mentioned in the website says
"Is your application urgent

If your application is considered urgent due to imminent travel, mail your completed application by registered mail to the address shown above.

Include a copy of your plane ticket and proof of payment of your ticket and write: “Urgent—Proof of travel included” on your envelope.

Note: A travel itinerary is not considered a satisfactory proof of travel."
how do you provide with a copy of plane ticket if you bought the ticket online, it will be itinerary right?

If you bought a ticket, you will have a receipt showing that you paid. Send that as well.
