My wife PR has expired in 2018. She has not visited canada since 2013. She retired 2 years back from her teaching job in mumbai.
Self is a Canadian citizen retired and staying in india since 2014. My son canada citizen since 2014 lives and works in Toronto. We lived in Mississauga from 2009 to 2014.
What are best opinions for wife to go to canada?
1. Get PRTD - possible to get after 5 years?
2. Spousal visa ?
3. Parent super visa ?
4. Visitor visa?

1. Yes, if IRCC will allow her to claim the time spent with you outside of Canada towards the residency obligation. You should try this first.
2. Only possible if she formally renounces her PR status first.

No, you don't have to move back to Canada and apply. No one here can tell you the chances. She need to try it first. You should contact the VAC or nearest Canadian consulate for the processing time and fee. Details should be on their website too.

Do you have a branch in India?

She needs to apply for a PRTD based on accompanying a Canadian citizen abroad and see if that is approved. That would be the first step. Normally would recommend trying to enter by land through the US but as a senior the ability to secure a health card needs to be considered.

Did you and your spouse live in Canada after she received PR? For how long? When did you get citizenship?
 
Both of us do not live in Canada since 2014. We all got PR in 2009, wife renewed her PR in 2013 and PR expired in 2018. I took citizenship in 2014. I have started to fill IMM5444 online.
I am applying for PRTD using IMM5444.
  • proof of the residential addresses of the person you are accompanying for the five (5) years before the application
For filling the form I have some questions
For 4.1 or Address History or 5.5 Time spent outside Canada

1. Last 5 years I have travelled in and out of India alone several times during the 5 years before the PRTD application and my wife travelled out of India once. In answer to the above questions do we need to show these periods away from each other in the application (as Entry and exit stamps of India are clear in the passport). Each year my periods of stay away from India are around 6 months mostly going out for work.(not a canada buisness)

2. For the below supporting documents we shall attach - please advise

Spouse Indian passports last 5 years;

my Canada passports last 5 years;

Citizenship certificate;

Marriage certificate;

Proof of Indian residential address for both of us - Indian driving license as it has Indian address or Indian home ownership

Expired PR cards front and back;

Any other documents to attach?
  • Canadian Income Tax Notice of Assessment (NOA) for the past two (2) years - Is this required?
  • school or employment records - Is this required? For whom - wife or myself?
  • any other documents you want us to consider - what can we attach?
Supporting documents may include:

  • Mandatory:
    • all passports or other travel documents that the person you are accompanying used in the five (5) years before the application;
    • documents showing the citizenship of the person you are accompanying, including the date the person became a Canadian citizen;

It appears that your spouse moved to India before you got citizenship so that could be problematic. Wasn’t the intent to remain clause for citizenship still in effect in 2014?
