I'm going to skip all the immigration stuff and focus on safety. Domestic violence is not okay and it is unhealthy for your son to grow up in such an environment. If your wife is physically violent towards you, report it to the police. It doesn't make you less of a man. People treat us how we allow them to, and if you keep taking it, she will keep at it.
The concern for you is that one day you lose your temper and hit her. You can be sure she will call the police, who will arrest you. If convicted(6 months in jail or more), you may be deported. She gets her wish without even sweating. So get your own place now and if you are concerned about her fitness as a mother, file for custody of your son. Do not return to the marriage unless you both go to counselling and changes are made. Goodluck!

You both obviously need to sort things out, for the sake of your child if not your marriage.

To put things in perspective for you, you CAN'T sponsor your parents for at least another 2 years, because there is a moratorium on parental sponsorships until 2014. Furthermore, if you or they cannot prove sufficient funds for it, they won't qualify for a super-visa either. So, I suggest that this is a useless bone of contention for you both to be fighting over, and that you resolve to drop it because it is pointless to fight over something you cannot do!

If there are threats to deport you, as you've already been told, unless you break the law, she can't effect anything against you immediately, because even IF she accuses you of marrying her to gain status, it will take CIC quite some time to get around to it. And she will need more reasons than spitefulness to substantiate her accusation.

If your home circumstances involve threats of violence, and/or if you are concerned for the well-being of your child, then 1) get OUT of the home and go somewhere safe and 2) take steps to protect your child by bringing the mother's actions to the attention of the authorities. If civilized ways of dealing with marital issues don't work, then take legal steps.

My tuppence, but then, free advice is worth what you pay for it.

SenoritaBella,

I wish that statement from your comment was true but sadly it is not. I am a sponsor who married an abusive addict, obviously I didn't know that little tidbit when I married him. He went to jail for hitting me, he was mandated to anger management and never attended. I had to leave my job, my city and start over again to stay safe. I consulted an immigration expert and was told there is no way that I can file any type of documents to have him removed from Canada. He stays unless he commits a violent crime, like murder or if he misrepresented himself during the application process.

Oh yeah on another up side he went to welfare, I had to pay it back.

I'm happy to be free of him but still have another 6 months to go on my sponsorship agreement, once that 3 years is over I will throw the biggest party!

Sorry to hear that you had such an experience. Even the cic website says, "if convicted of a serious crime, a permanent resident may be deported", which means it may or may not happen. It all depends on the circumstances or what they consider "serious".

Once you post something here, it will move the thread up to the top of the list, so it will become active again. It is better to just start a new thread, though, unless the topic is the same.
