Hi,

We ( myself and my wife ) returned to India in middle of 2018, since then we did not return back to Canada.

We are holding valid PR cards and expiring in middle of May.

I have few questions :

1) We intend to travel to Canada by 1 st week of April.

Shsall we be allowed into Canada as the PR card expires 30 days after our entry.

2) Will the border service ask any questions at the port of entry ?

3 ) I need to renew G driving licence and health card for both of us. Will there be any issue since we did not renew for long time ?

4) We need to look for accommodation. The land lord will ask any questions to us regarding expiring of PR card ?

I would appreciate reply from experts regarding this as this would be of big help to take proper decision.

Thanks in advance

1. Yes.

2. Without knowing more about your situation...

Likely, perhaps even very likely, since you will not meet your Residency Obligation (R.O.) to maintain your PR status. Nobody, here, can say for sure what will happen, but in any event you will be allowed to enter Canada. If the officer questions you and determines that issuing a 44(1) report is justified, it could lead to your PR status being revoked.

If you are fortunate enough to not be issued a 44(1) report, you and your wife would need to remain in Canada for at least 730 days before you could then apply for renewed PR Cards. It would be very difficult to live in Canada for 2 years without a valid PR Card, which would probably be needed for things like provincial health care.

3. I suspect that you may have issues with the health card, since you have not been a resident of Canada for 4-1/2 years. Same may apply regarding the DL.

4. I don't know if a landlord can even ask to see a PR Card. Check with whatever landlord/tenant agencies there are in the province where you are going.

It isn’t hard to live in Canada with an expired PR card. As long as they have a valid PR card when the initially arrive in Canada they should be able to renew their health card. Without a valid PR card it can be difficult to renew your healthcare in many provinces.

This family is a high risk of being reported for not meeting their RO since they may have zero days in Canada in the past 5 years when they land in Canada. If they don’t get reported at the border they will need to remain in Canada for the next 2 years and avoid any contact with IRCC.

Once their current cards expire, and with knowing that they will not be able to renew them, their life could be `less than ideal' for two + years.

They will also probably need to wait until they are considered residents for health coverage, since they have been gone for 4-1/2 years. Even with a valid PR Card, I'm not sure that they can arrive on a Monday, for example, and get medical treatment the following day.

If they have a valid PR card you can apply for a health card. They haven’t met their residency obligations to receive healthcare so yes they have to reapply for a health card and their SIN# may be on hold. PR card is essentially a travel document so if you remain in Canada you shouldn’t have any problems.

Thanks to all who replied.

I am intending to travel much before. May be in March.

So that I have clear 2 months validity time for PR card. I can renew health card, driving licence, etc.

Actuallly we landed long ago in year 2008. Since then we renewed two times PR card . Third time in May / June 2018, we renewed

PR cards and left canada in June 2028. This is the situation.
