When i applied for PR i declare that i have a son but i was married and i don't have a plan to sponsor my son because he has a health problem he has a spot on his lungs and he can't pass the medical exam,we dont have any agreement and commitment.My concern is that the CIC officer insist to have my son to undergo medical examinations,the problem is we already in separated life and my ex-girlfriend dont want to do the medical exam to my son.I already sent in a affidavit letter stating i will not sponsor my son in front of a lawyer.Would i be refuse for this reason?I apply under CEC,Thank you.

Dear, CIC likes third parties to confirm things and they don't actually believe us, you need to get proper custody documents from a court, or your ex+her lawyers stating that you have no custody over the child.
In addition if cic officers have any doubt that someday you will try to sponsor the child they will not approve you, so the custody papers need to be final giving all powers to the ex.

Thank you,But my problem is we are out of communication and my ex dont even want undergo such agreement or custody to be dealt.Is there by any chance I can do?

You will need to provide proof that your ex has sole custody of the child and that your ex has refused to have the child medically examined. I don't think a letter from you is enough. You need to provide the legal documentation that demonstrates your ex has sole custody and ideally some sort of communication from her demonstrating that she has refused to allow the child to be medically examined.

Is it also applied on my case because we were never married and there was no documentation done,and the birth certificate was just e-mail to me and i only sign it.Was there any option i could do? thank you
