I came to Canada on 2006 and met my husband, I stayed ilegal for almost 2 years and married him a year and 6 months ago.
We paid a lawyer to help us with the process so he sent my application to the immigration office on august 21 2009. It's been more than 7 months now and we don't get any answer. I tried to see my e-CAS and they can't find me, I call my lawyer and he says I have to wait because I'm not allow to call the immigration office but on the immigration website says I can call them if I waited more than 6 months.

I'm so confused now. I will appreciate if someone tells me how long is the process or my lawyer just ripped me off? Should I call immigration office?

Are you applying inland or Outland? I believe inland sponsor stage can take more than 6-7m... If Outland, your husband should have gotten indication of his approval to sponsor.. Typically this takes about a month Ecas can be tracked using the number provided on that letter..

Not sure when ecas is updated for inland...

Btw I don't believe there's any restriction on calling the call centre, who might be able to locate your file and tell you why you can't find it in ecas... I think your lawyer could, at a minimum, do that....

:( sorry... Some lawyers are just not good...

While I believe your timelines are within reason for inland, def call the contact centre and see if they can locate your file.... You should at least have the peace of mind that it was received and deemed complete... I believe the restrictions to contacting after 6m are for contacting the processing office directly, not the call centre...

I'm guessing your lawyer is playing tricks on you. Was he the one who sent in the application? If yes, did he give you any confirmation he sent it?

Agree with prof456. CPC-V is now processing applications received in Sept 29, 2009:

http://www.cic.gc.ca/english/information/times/canada/process-in.asp#perm_res

Call CIC to verify that at least they have received your application.

did u get first stage approval? AIP? open work permit? what did ur lawyer say? if u got that and it was transferred to local office its good news.
if u didnt get approval in principal, and ur application sent to local office, its not a good thing. i mean they might be not satisfied with ur application and want to interview u. it might take months to schedule interview.

u should really call CIC urself and ask everything. dont be scared, u can call them anytime and ask everything. lawyers usually are not trust worthy they just take money. many people say that here and i agree cause we had consultation at lawyer's too at the beginning but no good from him.

I would rely on the words of your lawyer. Did you see a letter from CIC yet? It's your case/file. You should be able to contact CIC and enquire/validate what your lawyer told you. I'd definitely be visiting him to get the letter.

Of course you can call the call centre, you find the number online . it is a public number!! the problem is that you have to have your client id number or the fees receipt number for the agent to check your file. Ask your lawyer for that number.
the call center number is 1 888 242 2100

First of all, you shouldn't hijack someone else's thread . . . especially when you applied outland and this thread is about an inland process. You're just not likely to get answers to your question that make any sense. Some people will just answer the original author's question and not even see yours.

That said, your application has not been in process at the embassy for nine months - you can't count from when it first went to the Case Processing Centre in Mississauga. You have to start from the date that Buffalo received the file. As I explained to you in another thread, Buffalo is processing spousal aps in 4-10 months after they receive the file. The necessity for a CSQ means you have to add at least another 6 weeks to the normal processing timeline - the overseas embassy will not work on the application until they have confirmation that Quebec, as well as CPC-M, has approved the sponsor. Since they're telling you that they have requested the background checks, it means they have received the CSQ and they are going ahead with processing - so that's good news.

What do you do? You do what everyone else does - you wait, and you try to wait patiently because if you start badgering them with inquiries and get all upset that it's "taking so long" when the application still meets the requirements for normal processing time, they're going to start wondering why you're so anxious and maybe suspect that you're just trying to get into (or stay in) Canada. Seriously, you really shouldn't stress (I know it's hard not to) unless your case goes beyond the normal timelines. That really shouldn't happen - although, if your medical expired, they may ask you to do another one and that could delay things. It's possible, though, that they could also extend your medical results for another year. Either way, it could be worse. It's been 3 years, 2 months and 2 weeks since Buffalo first got our application. They refused it the first time around - completely out of the blue - and after 2 years waiting for our appeal hearing, it took another 3 months to get back in process again, and now it's been 3 months in process and I'm still waiting on my new FBI. They gave me 60 days to do new medicals and get my FBI - but FBI is taking 3 months to send clearances back - so right now nothing is happening with my file at all. Just like you, all I can do is wait. Hopefully you don't end up having to endure what we have. When I was at the 9 months mark, I still had hope. A month later it all went down the tubes and here we are, years later, still waiting. Just be patient, that's seriously all you can do. You have to have faith that eventually it will all work out or the whole thing will make you crazy with the stress.
