your invitation letter, you were attributed points based on the fact that your spouse was non-accompanying. However, when you submitted your application for permanent residence, your spouse was changed to ‘accompanying’, thereby changing your CRS points. Your recalculated CRS score has now dropped below the pass mark for your draw.

This is what i have received from the Department, due to my mistake that i included my wife later after the invite which i should not have done,
but since the application offered me the choice so i assumed that its OK to include your wife and daughter, and after adding them my points went down below the threshold and i was no longer eligible.

Now the question i have is: should this be considered as a VISA refusal/Rejection ? i travel very frequently and some of the countries do ask if you have ever been denied a VISA etc, should this be included in my future application if they would like to know? does PR application different from a regular VISA

No It Does not mean you are denied visa, It means your applications now withstands non eligible as per the CRS.
You can reapply alone or along with wife etc if the Invitation letter is still valid or else can work on improving your score via IELTS & WES or obtaining Provinicial Nomination/ Job offer etc etc

The invitation letter is not valid as it has already passed the 60 days deadline, does that mean that i have to create a new profile and process my application again ?


Can someone please provide their expert comments on this ? i am still confused if this should be termed as refusal or not ? from the reason that
i have been provided its more of a eligibility issue.

It is considered as a refusal to your PR application at this point, but it should not be viewed as a refusal to your VISA. My guess is that at this stage it is not considered that you applied for visa, so no Visa refusal.

So its a PR application refusal not the VISA, i tried logging into myCIC account and my data is still there and the buttons for logging a new visa is still active, i am sure i can start a new profile for express entry,

But the big question still remains the same....

Is it refusal of VISA or application refusal..??

Sorry guys i know i am stuck on this question, but i would like to know it for sure as i am confused of PR applications are termed as VISA application.

generally while applying for any visa application it ask combined If u have been rejected for visa , permanent residency ,admission denied, refugee status. So in that case you have to mention it was refused. If anywhere it ask do u have have visitor visa refusal and another question is for PR then only PR was rejected (my personal point of view).
