PR application rejected due to Spouse PCC

Hi Friends,

This morning came with a bad news that I received message in my EE profile. My PR application have been rejected with reason that I have not submitted Spouse PCC for Republic of Congo and Letter of Explanation. I did not submit PCC for my wife because CIC guidelines clearly states that we must completed 6 months in a stint but my wife never completed 6 months in a stint and we went on vacation out of country in every 5 months. All her country entry/exit dates I mentioned in travel history of my spouse, still not sure why they mentioned whole period.

Please share your views, if any case has been reconsidered after refusal and how to approach CIC . Mail or written application to CIC for reconsideration?

Now even If I will reapply and create a new EE profile but my Nomination certificate has my current EE profile number then how CIC will recognize this new EE profile matched against rejected EE profile number ?? Do I need to obtain new Nomination letter having new EE profile number with it.

I have shared details below

Received OINP Nomination: 23 Dec 2015
Received ITA : 06th Jan 2016
eAPR Submitted: 03 March 2016
Application Declined : 06th Apr 2016

Current status of eCAS: Closed
Expiration date on OINP nomination letter: 20 June 2016
Also, OINP nomination letter mentions Express Entry number of above profile.

I had received Ontario PNP and recived ITA . Submitted my application on

I think the new rules for PCC are if you have spent a TOTAL of 6 months, not just in one stint.

Who needs a police certificate?
In general, you and all the people in your family who are 18 or older need to get a police certificate. You must get one from each country or territory where you have lived for six or more months in a row since the age of 18. (For example, if you lived in a country for eight months but left on a two-week vacation, that counts as living there for eight months.)

I guess I misinterpreted it ..

Any suggestion, what should i do now.

Sorry to hear your rejection,

You can send an appeal case to CSA and in the meantime you should create new EE application.
In my case, my first EE application has been rejected as well. Don't give up.

Wish your file will reopened soon.

How do we appeal case to CSA and yes I got some information from other post which is positive.

In the event that CIC rejects a PR application that is based on an OINP nomination under the Human Capital Priorities or French-Speaking Skilled Worker Streams, you are correct that the Express Entry Profile under which the nomination was issued becomes invalidated.

A detailed explanation of why the original EE Profile was invalidated;
The new EE Profile number and job seeker validation code; and
The previous EE Profile number and job seeker validation code.

On receipt of the above, the OINP would enter the EE Portal system and attempt to transfer the nomination from the old profile to the new one.

The only concern I see if you send CSE then also you make new EE profile.

* You ask OINP to transfer nomination to new profile and they do it. Later if IRCC decides to reopen your application then they might not see your PNP. It is bugging me (I could be wrong too but it's better to be safe)

I guess you missed the new rule about PCC that total stays in a country are combined.

What bothers me though is the inconsistency of IRCC. For some people, they will be given opportunity to submit the PCC.

I am not sure they will open your application again cos it was not an error from their end.

My advise is for you to forget about the old profile and open a new profile. Then, contact OINP to link your PNP with the new profile. You will obviously get a new ITA immediately

Can you post the link here. I tried searching for it on the IRCC website but I found out the old one - 6 months of continuous stay. I believe it was changed on 11-Feb.

I just dont get CIC... why wouldnt they just request a proper PCC? why refuse straight away...

Thank you for your advise. I have created my another EE profile and will send mail to OOPNP for transferring my nomination points to new EE profile.

Sorry to high jack this thread, but in the link you provided it does not mention anymore being older than 18! I am 32 now and I spent time from 1 year of age till 5 year old in some country. Should I provide PCC for that country?? :(

yes you went after 5 months but the gap you returned must be less so they considered it continuous stay.

Did they mention you can resubmit in so many days?

No, there is no how you can commit a crime at that age.

Hi,
You can mail and ask OINP to transfer for your Nomination to the new EE Profile that you will/have created. I think they do transfer if the case is genuine. A LOE is must. Make sure you explain OINP well.

I'm sure OINP will transfer the nomination on to you new EE Profile.
