PR application - coming from Australia

Hi there.

It was suggested that I post questions regarding my situation in this forum.

I have already received some great advice. Just wanting to get my head around this whole visa application process.

My situation is pretty much this: My partner, an Australian, is currently on a working holiday visa in Canada. I am still in Australia. He has been in Canada since August 2013. We are both Australian citizens. I am 32, so am now ineligible to apply for the working holiday visa. His employer in Canada is now preparing the paperwork to sponsor him for permanent residency. We want to apply for me to be a PR aswell, as his common law partner.

In relation to common-law partner, we have been together for 7 years, and have spent 4 of those years living together, although not immediately before he left for Canada. We owned a house together, so proof of living together will not be an issue.

We had originally thought that we would have to wait for his PR to be approved, and then he apply for me as his partner. I have, however, received some feedback that we can include myself, as a common-law partner, on his employer sponsored application for PR, which will mean that both our applications will be processed at the same time. Does anyone have any advices for me in relation to his?

Hi

You are still considered common-law even though you aren't currently living together. You will need to show that you have maintained the relationship since you stopped living together.

You must be declared as his common-law partner in his PR application. If he doesn't declare you, it is misrepresentation; not only will he never be able to sponsor you but he could also lose his PR status. You will receive PR at the same time.

Thanks for your response canuck_in_uk.

I'm not sure what else I need to get guidance on at the moment...I was all over the sponsorship application before being told that both our applications should be processed with his!

I'm sure I'll have many questions once the process begins :)
