PR application as in CEC refused

Hello.

My application for PR as in CEC was refused.

It was clear that wrong assessment criteria was applied on my case.

below is the notification which was sent from OTT Pilot processing center.

....I am not satisfied that you meet the skilled work experience, requirementstter of reference from previous employers stating your duties, salary, hours worked and time spent working in Canada. In the absence of information from your employer that we can verify, I am not satisfied that you have acquired 24 months of full time Canadian skilled work experience in the National Occupational Classification type 0 or Level A or B within 3 years prior to your application....

Now, my application was suppose to be assessed under 'Post-Graduate stream' which only requires minimum 12 months of canadian working experience. (I have been working for 18month so far at current position)

I was trying to figure out what have I done wrong.

What option do I have now?

Question for you: did you graduate from Canada?? if you did, then you are required to have a minimum of 1yr of experiance, but if you didnt and you have been working in Canada only, then you need a minimum of 2 yrs ...

Here's the req in the CIC website:

You must meet these minimum requirements to apply for permanent residence under the Canadian Experience Class. You must:

•plan to live outside the province of Quebec
•be either:
◦a temporary foreign worker with at least two years of full-time (or equivalent) skilled work experience in Canada, or
◦a foreign graduate from a Canadian post-secondary institution with at least one year of full-time (or equivalent) skilled work experience in Canada

Yes

I have graduated from a University and hold Bachelor's degree which was 4 years of full time program. I have a valid 'Post-Graduate work permit'

And have been working more than 18 month within 24 months from the time I submitted my PR application.

I do certainly meet the requirement under 'POST-GRADUATE STREAM'.

:( something seems worng here ... I am not sure what can you do now ... can you appeal??

Maybe other members in the forum can help or provide comments?

I am still waiting for my AOR and now i am very concerned :( ...

It could be a few things -

1) Perhaps they did not assess you as a post-grad - Did you provide all the required documentation for your education in Canada?

2) Perhaps the problem isn't the 1 year vs. 2 year employment requirement (even if they wrote 2 years), but whether or not your employment was skilled.

3) If everything was correct with your application and the VO simply made an error, read the following:

Only reason m thinking of refusal is that u applied under CEC and not postgraduate stream.. initially PGS falls under CEC category.

CEC requiremnt for students is that u r in school under minimum of 2 years full time and work 24 months of full time to qualify for CEC. now with that being said, u have finished school for 4 years and worked 18 months of 24 months full time. ur application should hve the date after completion of 24 months of full time.

u can consult a lawyer for further opinion, Plz dont tke me wrong m just sharing my thoughts.

For international graduates is 12 and not 24 months of skilled work experience

Let's suppose he didnt. Why is the officer saying 24 months when the application was as an international graduate? Mistake?

My application was submitted in December 2011.

I filled out the application form under Canadian Experience category. I looked through again and there was no instruction saying I needed to indicate I am applying as 'Post-Graduate stream'. I guess both 'Temporary Foreign Worker' and 'Post-Graduate' stream fall under the same category.

First of all, I have submitted all documents. Job Letter, Post-Graduate Work permit, T4 slip copies, School transcript, copy of my diploma...everything that was required.

Then I got an email of 'Acknowledgement of Receipt' from OTTPilot processing center this week and the very next day I recieved another email of refusal notification.

I don't know why VO had applied wrong assessment criteria and I don't really blame them because I too sometimes make mistakes. We are all human beings. All I want to know is once your application is refused, is it possible to request for reassessement for the refused application? Is it just easy as writing them a letter saying 'Oh, i think u made a mistake. Please review my application again'? If I must make my appeal to federal court.. (which would make me really pissed), what would be the process?

P.S the letter which was not submitted was for the work experience that i did earlier which I didn't count as my work experience. If I did count those, I already have more than 2 years.. almost 3 years of experience. The company went bankrupt and I have no contact info for the owner now. This is what the OV is talking about.

now i realized why some people suggested me not to mention the work experience that i do not intend to use towards my CEC work exp calculation....... maybe the VO thought you were under foreign worker stream because you provided almost 2 years of work exp....



:'( im worrying about my own case now.... i mentioned my first work exp which only lasted one month.... I didnt provide employer contact information or reference letter for that because i didnt plan to count it as my CEC work exp.....

Very sorry to hear about it. Just wondering if you had provided your UCI number? That number essentially fetches out your history of different statuses in Canada i.e. Student, PGWP, Worker etc.

Who suggested you that?

Im on the same boat. My current job is skill level B and will provided reference letter; but during the last 3 years I had 3 different jobs (skill c and d) and I have only been able to get one letter of reference.

Whats the opinion on this one? should I submit that letter and explain I wasn't able to get the other two letters? Those last two are from places I worked for 3 and 2 months at each job.

Why bother sending letters of reference from those jobs? CIC clearly only looks at 0, A, B. Even if I could get those letters, I'd rather not attach them, I'd want to give them exactly what they want, and would want to minimize the chances of being misunderstood.

Besides, if the purpose of that is to show that you've been paying your taxes and earning income, a better way would be to attach your Tax docs and T5.

Just my two cents.
