Hello Guys,
I need help from seniors. I am currently a full time student at a uni and I am enrolled in 2yrs diploma of computers. I did masters in India and most of the credits for the course (in Canada) are transferred here in Canada which reduce one year of study here in Canada. Now I am going to complete my second year study after this fall 2013. this means I have completed One year of study in Canada. I talked with university advisers they said uni will give you a certificate of 2yrs diploma. My question is that for how long I will get my Post Graduate Work Permit will this be of same length of my study in Canada? will immigration officers consider my actual physical study here in Canada (which is one year) or they just check my certificate (which will be of 2yrs diploma certificate)? I am confused what to do? One more question is that if I will get Post Graduate Work Permit for the length of 1yr then can I apply to extend this work permit. I talked with my immigration consultant and he said if I will get work permit for 1yr and I can apply for extension of this work permit if my employer will say to immigration that I need this employee to continue my business ! Is this true or do I need to something else?

It depends on the documents you submit. When i submitted my post grad application they wanted something more than just a copy of my degree. They need to see something like a transcript or letter of enrolment that list both that you've completed the degree and the duration of the degree. If you get a letter of enrolment it will say that you've completed a two year degree and they will issue you a two year work permit . However if you submit your official transcript it will show that i've technically attended school here for 1 year and you'll get a one year work permit. Also check your passport expiration date because they only issue permits until the pass port expiration date. I've seen people get one year work permits instead of 3 year ones for that reason.
You can't "extend" a post grad work permit. You've need to apply for a new one with your employers help. Post grad work permit are open and you can work for any employer where as the one you will get after your employer applies for you will be closed and you will be only allowed to work for that employer

I remember one guy who was studying with me, did his 1 year Doploma (2 sems/8 Months) cource.
By mistake the College gave him a letter mentioning that he did 2 years of Diploma.....
Then he applied for PGWP, with that letter and luckly he received 3 years of work permit. Lucky Guy.................


For me they have issued a 16 months of workpermit, where i have done a 2 years (4 sems/16 months) diploma...
I had to go through the lawyer ($1000 + tax) and had to reply for my PGWP............here again they have sent me a new PGWP valid 3 years :)

So I guess it all depends on the Letter and the Officer

I have a feeling you will get 1 year PGWP (just my feeling). Cause they will know from your study permit - when you entered Canada, and for how long you are studying IN Canada. Also they are saying:

- You must have studied full time IN Canada and you must have completed a program of study that lasted at least eight months.

If less than two years but more than eight months:
- You may get a work permit for a period no longer than the length of your program of study (for example, if you studied for nine months, a work permit may be issued for a period of nine months)
So since you are going to be studying in Canada for 1 year, you may get an 1 year PGWP.
Its just my opinion, and if I were you, I would prepare myself for the 1 year PGWP.

For Extending PGWP:
You (your employer) would have to apply for LMO (labor market opinion). After that is approved, you can get a normal work permit.
