Post doctoral fellow for EE?!

Hi Guys,

I am on a post doctoral fellowship. If I want to apply for CEC through EE, how can I get the LMIA?! My employer (university) says there is no way we advertise your position. And as far I know, without LMIA my chance is super slim and almost nothing.
Please help.

Yeah, we are victims of this new system......kinda like hen and egg problem......we cannot get an LMIA because our job is exempt......and CIC hasn't taken any steps to rectify our situation......my current contract expires in Oct and my supervisor has assured me that he will extend my contract for atleast another year......but he is helpless as far as LMIA is concerned because there is no LMIA for postdocs.....so our best bet is to wait till non-LMIA poeople get a chance......in the meantime, score high on IELTS, get ECA, and if married, get your wife's ECA on the very least......and then hope for the best.

Just to be clear, postdocs are LMIA exempt for the purposes of applying for a work permit. This is intended as a facilitation measure for universities and workers. But nothing prevents the employer from applying for an LMIA, either for the worker to obtain a work permit or for PR.

I am not sure if that is true, I think any application for LMIA for postdoc would be rejected under the pretext that its LMIA exempt category.......reason why I say that is because last year, Canadian Bar Association, under its recommendations for EE, appealed to CIC to give special status to postdocs since they cannot obtain LMIA. So they recommended a special LMIA category for postdocs which has no advertising requiements. I highly doubt that CBA would have asked for such a thing if it were possible to obtain an LMIA for postdocs

I think Postdocs and research scientists really deserve a special LIMA category. Our researches are so specialized, sometimes only very few people on this planet can understand what you are doing. Can you expect how many Canadians will apply if there is a Job Ad requiring the knowledge of the pleiotropic phenotypes of Elongator mutants in budding yeast or wobble uridine tRNA modification? Doesn't it deserve a positive LIMA? However, we are normal considered as cheap labor. Nobody gives a shit about postdoc....even janitors have a more stable life than us...

Is the system asking any question like "Does your job need LMIA"?? If so then we can select NO and enter the exception code which we provide for WP.

If I remember correctly, there is a question about work permit being LMIA exempt, but no mention of job being LMIA exempt.

My contract expires at the end of October 2015 and it will be renewed for at least another year.
At the answer if an LMIA was required for my job I answered NO.
So, even though I have a job offer, I cannot get the 600 point! (and I have to register to the job bank).
This is really unfair!!!!! Exspecially because the CIC wrote on their website that there was no need to rush and then they changed the rules just one month after the start of the EE system!
We should all write to CIC and complain, so they will realize that they have to do something for our cathegory. I have already did it.
Please update this forum if you know of any changes.

--- At this point we should be given 600 points and after ITA they can verify the letter from university. Some immunity should be provided here not sure who will take our suggestions/queries .

My postdoc friend faces the same issue. Without 600 points, it's quite unlikely to be selected from the poll to be honest.

Did anyone raise this issue to CIC? Do you know how can people let them know?

This article written by Canadian Bar Association named Express Entry (sorry. Not allowed to post links) mentioned it and made reasonable recommendations. I feel that they might change the rules (for example, give additional points to LMIA exempted scholars) as long as people make their voice heard.

Can we do something joint effort to request immigration minister for consideration...at least even if not not full 600 points but 300 or something like 100-200 CRA score who exempt for LMIA

I guess, we are not many people~1000-2000, though I am not sure..

In this case its not big deal to consider our request,

Basically we are contributing Canada via very high standard research

Lets think about this and post reasonable idea toward this

I'm wondering, even though Postdocs are LMIA-exempt, you can still apply for one, right? If you work for a big university, they should have the resources to apply for LMIA's... Many public universities in Canada are government organizations anyways, so they should know how to get around/satisfy government regulations for LMIA. So it doesn't hurt to talk to your supervisor about applying for a LMIA...

To the best of my knowledge at least UBC won't support postdoc applying for LMIA. We are just a group of cheap temporary labor in the throat-cutting academia society. Similar to our African/Asian/European slave predecessors 200 years ago, boating thousands of miles and want to set our foot on this land. Why do the slave masters care about our welfare and future? If you are not happy with your position in my sugarcane farm and want to ask for more, you are welcome to get your ass back to the boat because there are twenty more slaves waiting in the line who are full of passion in this feces shoveling job!! It sounds harsh but the reality is like that, my friend.....
