Hello Everyone, Me and my fiance have some important question to find out
My future husband has already got his PR in Canada... He is Citizen of India, I`m citizen of Armenia, we are getting married in 2 months, so I will be moving to India...After that he is going to apply for my spouse visa... Question is will it be possible to apply through India, even though I`m Armenian citizen...
Thank you in advance :)

When you enter India, are you going to enter on some sort of permit (work permit, study permit, residency permit) that allows you to live in India for at least one full year? If so, then yes - you can process your application through India.

Yes, as we are going to get our marriage registered in Armenia, I will have right to apply for entry visa

////ENTRY VISA (XV)

Long Term/Entry Visas are issued to persons of Indian origin (PIO & OCI card holders), their spouse and children for duration of up to five years. For spouses of Indian or of Indian origin, legalized/Apostilled Marriage certificate is required for issue of Ex-Indian Visa. Members of the family of a person employed in India are also eligible for Entry Visa. In the latter case, documents establishing the employment of the spouse along with a copy of his/her Employment Visa must be submitted. These will, however, be granted depending on the purpose of visit and eligibility on a case-to-case basis. An Entry Visa is given for a specific purpose or other purposes which do not fall under other categories or non-business related purposes. An Invitation letter is required from concerned organization/authorities in India. Valid for six months to five years stay with multiple entry. Long term 5 years entry visa is issued to people of Indian origin only and hence appropriate documentation is required to substantiate Indian origin e. g. Old Indian Passport copy or any other document, duly legalized or Apostilled as the case may be, that can establish applicant’s Indian nationality. Please note the validity of the visa is effective from the date of issue. For spouses of Indian or of Indian origin, legalized/Apostilled Marriage certificate is required for issue of Ex-Indian Visa.///

It is such a relief , if there won`t be any problems in applying from India...You are sure in your information?

Thank you very much! :)

Will your husband be resident in India, or in Canada, when he applies to sponsor you?

Your husband has to be living in Canada to sponsor you. Only Canadian citizens can sponsor while abroad.

As a PR, he has no choice. He must be resident in Canada for the whole of the application duration, until the COPR/visa is issued.

If you are legally admitted to India for at least a year, as Scylla pointed out, you can apply as a resident of India, so follow those guidelines :).

Thank you Lammawitch :)
But now I`m a bit confused, does legally admitted mean that I have at least one year Indian visa, or that I have been living in India for one year

You cannot now select where your application will be processed. That option has been removed.

You will need a visa permitting at least one year's residency in India (X, I presume).

That's one of the things bothering me about your questions/situation. Suppose you only get a 6 month visa for India to start with? you & your future spouse have a two-fold problem:

for you to get an X visa for India, he's going to have to be with you IN India, at least for the time it takes to run around sorting out that process. And you might only get 6 months (extendable to eventually 5 years) to start with. In which case he'd probably need to be in India to help process the extension....

For him to sponsor you to come to Canada, he needs to be here in Canada for the entire processing time (minus short holidays). ....

Do you see the potential problems I'm seeing??

It seems to me that processing times for Armenia are shorter than those for India?
