How are you? hope all is well. No need to panic here is a copy of my letter, there is also a form to download. If you filling out for yourself please attach ALL DOCUMENTS CBSA give to you. (copies), remember you have to be very apologetic about the situation. Go to CIC website type authorization to return form. There is also information there about it.

Dear Applicant:
This refers to your application for a permanent resident visa.
As you were previously removed from Canada, you are currently inadmissible to Canada and you require authorization to return to Canada if you wish to continue with this application for entry to Canada.
Subsection 52(1) of the Immigration and Refugee Protection Act states that:
“If a removal order has been enforced, the foreign national shall not return to Canada, unless authorized by an officer or in other prescribed circumstances.”
Should you decide to apply for authorization to return to Canada, you must complete the attached form indicating why special considerations apply in your case and pay a processing fee of CAN $400.00.
Please note, there is no guarantee your application for authorization to return to Canada will be approved.

Method of payment

Fees are payable in the form of a bank draft or certified cheque. Cash is not accepted for fee payment. The bank draft or certified cheque should be made for the exact amount and payable to "High Commission of Canada".

In addition to the above, please submit the following:
- Complete an immigration medical exam. Applicable instructions and forms have been sent to you in a separate email.
- Please have your fingerprints taken at a police station nearest to where you live, see the attached letter.
You have 60 days from the date of this letter to submit your request for authorization to return to Canada along with the processing fee(s). If you choose not to apply for
authorization to return to Canada, your application for entry to Canada will be assessed on the basis of the available information.
Please indicate your file number in any correspondence with this office.

Application For Authorization To Return – Checklist

According to paragraph 52 (1) of the Immigration and Refugee Protection Act, any person deported from Canada cannot return without authorization. In order to request this authorization, you must complete the following checklist and provide all requested items.

Complete and place this checklist on top of your application.

Consult our website for forms and instructions: www.austria.gc.ca.

Any document not in English or French must be accompanied by a certified translation.

Failure to submit all required documentation may result in the refusal of your application or delay processing.

Do not send original documents unless we specifically ask you. Send us photocopies of all other documents.

False statements or submission of fraudulent documents will result in refusal and may lead to legal action against you.

Please note that the documents submitted with your application become the property of the Government of Canada and cannot be returned to you in any form. Please ensure that before submitting your application, you keep a copy of all documents you may need later.

The decision to grant an authorization to return to Canada is made only following an evaluation of all the factors related to the deportation and the actual situation of the applicant. At this point, we cannot guarantee that your application will be accepted. A deportation order is issued only when a person has made a serious violation of the Immigration Act.

You must submit the following items:

Application for Authorization to Return to Canada completed, signed. The form must be completed in block letters or typed. Answer all questions. If not applicable, write N/A.
A criminal clearance certificate from the National police authorities in all countries where you have resided at least six months since reaching the age of 18, including an FBI certificate for the United States and (if appropriate) an RCMP certificate for Canada. This clearance must be based on a fingerprint check. See our Police Certificate Instructions.

Two passport photographs for each applicant. Signed, dated and taken in the past six (6) months. Write the name and birth date of the individual on the back.
Processing fee - Ensure that you have paid the correct non-refundable processing fee. Include the receipt with the application. Regarding removal costs: if you are a foreign national and have not paid the removal costs and if your application is accepted, we will inform you of the fees to be paid before issuance of the authorization to return to Canada.

Passport - Photocopy of the pages from your passport showing the first page, your name, date of birth, country of birth, biodata, passport number, and expiration date.
Proof of your financial situation, or that of the person upon whom you depend, such as:•a monthly bank statement indicating the balance
•proof of employment or
•other sources of income (pension for example).

A written statement describing the circumstances leading to your removal/exclusion from Canada and the reasons for which you now wish to be admitted to Canada. In the case where a person has been deported by reason of criminal inadmissibility, the applicant must, except in exceptional circumstances, prove that he has been rehabilitated and is no longer inadmissible. If the crimes were committed in Canada, he must demonstrate that he has obtained a pardon from Canadian judicial authorities. This pardon, or rehabilitation, does not a guarantee that an Authorization to Return will be issued.

If applicable, you must also submit:

If you would like Citizenship and Immigration Canada (CIC) to release information from your case file to someone other than yourself, you must authorize us by completing Authority to release personal information to a designated individual (IMM 5745).
If someone is assisting you in completing your application or you would like someone to do business with our office on your behalf, completed Use of a Representative [IMM5476].

Hi everyone, CSE is back up and running... I sent an enquiry and rec'd a response within a few hours... unfortunately, the response was basically like, "we're working your husband's ARC, leave us alone" and didn't give a timeline, etc., at least they responded quickly and didn't identify that they needed more information.

So now we continue to wait. Hope everyone is doing well.

CSE is the case specific enquiry email form and it was down for a few weeks!

Oh ok. Is it that's why they sending automated messages? And I see that POS is good for interview but if our spouses live in ja how would they have interview? I guess they would have to send it to ja right! Sigh

I'm not sure maybe they're sending automated messages to inquiries that have a template answer? before the system was completely unavailable... and now it is available... as for the interview scenario... I'm not sure what would happen with a JA applicant getting an interview by POS... I've never seen this before.

Hello everyone ,so back from my interview in trinidad and lemme tell you very nerve wracking I got soo nervous I gave my daughters bday for my husbands and my hbs for hers.they're the same month a week apart when I realised I apologised and told her she simply raised her eyebrows like she caught me in a lie,like wth it happens right,lol.Iterview was about an hour 20 mins.and yes i was asked alott of question about my refugee and the rest about my relationship.i got some of the dates wrong,damn me for my short term memory!!I did not think it went too well or too bad but she at the end told me she will consider this relationship as a genuine one..We then given some forms and told i have to apply for an arc and redo my medical..>we thought the arc would be just the form and the letter but now i think weyre wrong..can someone who has done the arc tell me about the information they included in it,weyre doing it on our own as the lawyer who did our application has requested more money which we dont have..OK to top it off heres a question im literally dying to get and answer to.My hb and i had a little too much fun in trinidad and had an accident??If chances are that this accident did turn into something more what would happen to us and the application at this stageee?????please help anyone weyre freaking out!! :'(

Hello LonelyGirl,

Welcome, I'm happy to hear everything went well at the interview. No need to think the IO caught you in a lie they are trained for that, she knew you were simply nervous and got mixed up with the dates. Because of your nervousness your interview went quite longer than normal, it's usually between 45 mins to 1 hour. My lawyer did tell me I was going to be asked a lot of questions about my refugee, and also but my relationship with hubby. This was to ensure you didn't marry to get PR status in their country.
Because you mixed up all the dates got some wrong, hence the reason the interview went on for so long. :p

I'm glad that is behind you now, time to get down to serious business. First step call and make your appointment (if necessary) for medical. The ARC application has to be a summary of your case, while doing that you have to include meeting hubby and establishing yourself while there or how you will contribute to Canadian society. You must be apologetic about overstaying, and you regret every moment of it.

About the accident that has noting to do with your immigration situation, you did not commit a crime in any form. NO NEED TO FRET ABOUT THAT...... :D
