Hi Everyone,

I am applying to sponsor my wife. regarding the police clearance our lawyer is advising that my wife police clearance can be only from were she lived most after 18, which is her home country. She did live however in the US as well about 18 months but our lawyer is saying that it's not necessary.

Thoughts?

My Lawyer has said the same. I have lived in China and Sri Lanka for more than 3 years in each country in the last 10 years. He confirmed I do not have to arrange PCCs from those countries. Only the country I have spent most of my years after I was 18 years old.

This however contradicts the information the COC website has. So I am kind of concerned and worried too.

Your best bet is to get all the PCCs from the countries that your wife had been living there for over 6 months, after she turned 18. From previous posts on this forum, all those PCCs will be required by IRCC.
 
From IMM 5289:


The principal applicant and each family member 18 or older (who are not already Canadian citizens or permanent residents), must submit police certificates from the following country or countries with the application:

  • Current country of residence if you (or they) have lived there for six months or more.
    and

  • The country where you (or they) resided for most of your (or their) life since the age of 18.

  • Current country of residence if you (or they) have lived there for six months or more.
    and

  • The country where you (or they) resided for most of your (or their) life since the age of 18.

Is this the latest information from IRCC website ? I had read some other information where in they needed PCCs from each country one lived for more that 6 months since the age of 18.

It is a big relief if they just need PCC from the country where one has spent most of the years since the age of 18.

Yes this is what is required, however the lawyer is saying, from what they see, that it not super important to obtain them.

Not sure.

On the other hand it's impossible to obtain it from Saudi Arabia, one the countries that she lived in for more than 6 months. (About 16 months).

When we phones their embassy in Ottawa they said someone in Saudi Arabia has to issue it. While we don't have anyone there to do it for us. And it's too expensive and hard to travel just for the certificate.

At the bottom of the webpage I got that from, which happens to be the online IMM 5289, it says the page was modified on November 27, 2018, so I'm guessing it's the latest information.

By the way, I'm not saying it's one way or another. I had always thought it was all countries one has lived in for 6 or more months since age 18, but maybe I was wrong. I'm simply copying what it says in the official complete guide.

My lawyer maintains the same that I just need PCC from the country I spent most of my years since 18. Have submitted the PCC accordingly. Let’s see what IRCC has to say about it.
