Updated: Temporary public policy to exempt certain out-of-status foreign nationals in Canada from immigration requirements during the coronavirus (COVID-19) pandemic
Background:
Since January 30, 2020, when the World Health Organization declared the Coronavirus (COVID-19) outbreak to be a Public Health Emergency of International Concern, foreign nationals in Canada - whether they were in Canada at that time or arrived thereafter - have been, and continue to be, affected in many ways, including the loss of temporary resident status. In recognition of the ongoing challenges these foreign nationals in Canada face, there is a need to ensure that they continue to have options to remain legally in Canada during these uncertain times.
I hereby establish that, pursuant to my authority under section 25.2 of the Immigration and Refugee Protection Act (the Act), there are sufficient public policy considerations that justify the granting of exemptions from the requirements of the Act and the Immigration and Refugee Protection Regulations (the Regulations) listed below to foreign nationals who meet the conditions (eligibility requirements) set out below.
This public policy will:
  • provide eligible foreign nationals (visitors, temporary workers and international students) who have fallen out of status during the COVID-19 pandemic (i.e., between January 30, 2020 and May 31, 2021) with more time to restore their temporary resident status;
  • exempt eligible foreign nationals from the requirement that a work or study permit not be issued if they have not complied with certain temporary resident conditions; and
  • allow eligible temporary workers applying for a work permit supported by a job offer, to work while a decision on their restoration application is pending. This includes former workers who have applied, or will apply, within 90 days of losing their temporary resident status, and those availing themselves of the public policy exemption to apply after 90 days have past.


i have read this in ircc website.. so does this mean that tfws can continue working even if they’re in the restoration of status as a worker.

As I already told you when you apply for restoration application and you have to send webform .

In order to be eligible for this interim work authorization, foreign nationals need to have submitted an employer-specific work permit and restoration application and paid all fees. They must have held a valid work permit in the 12 months before the date on which they sent in their restoration application. They intend to work for the employer or occupation listed in the Labour Market Impact Assessment (LMIA) or the LMIA-exempt offer of employment included in their work permit application. They have filled out an IRCC webform to apply for the public policy and they have requested that the exemption be applied until a decision is made on their work permit application.

Here is a hypothetical example of someone who may apply for an interim work authorization, based off the Immigration, Refugees and Citizenship Canada (IRCC) webpage.

Min’s permit expired on December 30, 2020 and she fell out of status. She then submitted a restoration and work permit application within 90 days of losing her status, on March 1, 2021. As a result of the public policy, she is able to work while IRCC is processing her work permit application.

However, it would not apply in this hypothetical example.

If you applied to restore your temporary resident status as a worker with an employer-specific work permit

You may be eligible to apply for an authorization to work while you wait for your application to be processed if you
  • held a valid work permit in the 12 months before the date you submitted your application to restore your status as a worker, and
  • will work at the same employer and occupation that’s specified in the LMIA or LMIA-exempt offer of employment included in your work permit application.
How to request consideration for an interim work authorization
Step 1: Fill out the IRCC web form
After you apply for an employer-specific work permit, fill out the IRCC Web form.
When you fill out the Your enquiry section, you must copy the text and paste it into the web form. Make sure you fill out the sections in square brackets, including the
  • dates
  • name(s) of employer(s)
  • title of your job
If you applied on paper and don’t know your application number, include your courier tracking number. This will make sure we find your application.
If you have other questions, you need to fill out a new IRCC Web form.
Avoid delays
You must include the code PP2.RESTOREWORK2020 when you copy and paste the text below. We can’t prioritize your application without this code.
